Penzo 6 7 For An Act To Be Entitled 8 AN ACT TO AMEND THE LAW CONCERNING THE ADMINISTRATION 9 AND BENEFIT PLANS OF THE STATE POLICE RETIREMENT 10 SYSTEM; TO AMEND THE SURVIVORS' BENEFIT OPTIONS UNDER 11 THE STATE POLICE RETIREMENT SYSTEM; TO AMEND THE 12 PROVISIONS CONCERNING THE TIER TWO DEFERRED 13 RETIREMENT OPTION PLAN UNDER THE STATE POLICE 14 RETIREMENT SYSTEM; AND FOR OTHER PURPOSES. 15 16 17 Subtitle 18 TO AMEND THE SURVIVORS' BENEFIT OPTIONS 19 UNDER THE STATE POLICE RETIREMENT 20 SYSTEM; AND TO AMEND THE PROVISIONS 21 CONCERNING THE TIER TWO DEFERRED 22 RETIREMENT OPTION PLAN UNDER THE STATE 23 POLICE RETIREMENT SYSTEM. 24 25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 26 27 28 SECTION 1. Arkansas Code § 24 -6-504(3), concerning employer 29 contributions to the Arkansas State Police Officers' Tier Two Deferred 30 Retirement Option Plan, is amended to read as follows: 31 (3) Seventy-two percent (72%) One hundred percent (100%) of the 32 monthly retirement benefits that would have been payable had the employee 33 elected to cease employment and receive a service retirement shall be paid 34 into the Arkansas State Police Officers' Tier Two Deferred Retirement Option 35 Plan account. 36 As Engrossed: H3/31/25 H4/2/25 HB1336 2 04-02-2025 09:45:58 LJH112 1 SECTION 2. Arkansas Code § 27 -53-210(b), concerning the partial 2 reimbursement to the Division of Arkansas State Police for the cost of making 3 copies of motor vehicle accident reports and records of traffic violations, 4 is amended to read as follows: 5 (b)(1)(A) In Except as provided in subdivision (b)(1)(B) of this 6 section, in order to partially reimburse the division for the cost of making 7 photostatic or written copies of motor vehicle accident reports and copies of 8 records of traffic violations, there shall be charged a fee of ten dollars 9 ($10.00) twenty-five dollars ($25.00) for each copy of a basic accident 10 report and a fee of one dollar and fifty cents ($1.50) per page for 11 each copy of a supplemental report. 12 (B) The fee charged for a copy of a basic accident report 13 under subdivision (b)(1)(A) of this section shall be ten dollars ($10.00) for 14 a person who was involved in the accident for which the basic accident report 15 was generated. 16 (2) All funds collected under this subsection shall immediately 17 be paid over by the division to the Treasurer of State and shall be credited 18 by him or her as a special revenue to the Division of Arkansas State Police 19 Fund with: 20 (A) Ten dollars ($10.00) to be used for operations; and 21 (B)(i) Fifteen dollars ($15.00) to be used for the 22 benefits under §§ 24 -6-216, 24-6-408, and 24-6-504. 23 (ii) The transfers under subdivision (b)(2)(B)(i) of 24 this section shall be limited in use solely for the purpose of funding the 25 State Police Retirement System. 26 27 28 SECTION 3. EMERGENCY CLAUSE. It is found and determined by the 29 General Assembly of the State of Arkansas that certain provisions of the 30 Arkansas Code concerning the State Police Retirement System are in need of 31 revision and updating to maintain the retirement laws in conformance with 32 sound public pension policy; that the State Police Retirement System operates 33 on a fiscal year of July 1 to June 30; that having a July 1, 2025, effective 34 date is necessary to allow the provisions within this act to begin on the 35 first day of the fiscal year to provide proper administration of the 36 As Engrossed: H3/31/25 H4/2/25 HB1336 3 04-02-2025 09:45:58 LJH112 procedures herein; that such revisions and updating are of great importance 1 for actuarial purposes and to protect the benefits to members of the State 2 Police Retirement System; and that this act is necessary in order to maintain 3 an orderly system of benefits for the members of the State Police Retirement 4 System.
