Johnson 5 By: Senator Irvin 6 7 For An Act To Be Entitled 8 AN ACT TO INCREASE ACCESSIBILITY WHILE ENSURING 9 QUALITY FOR CERTAIN FACILITIES PERFORMING MAMMOGRAPHY 10 SERVICES; TO AMEND THE LAW CONCERNING THE QUALITY 11 STANDARDS FOR ACCREDITATION OF FACILITIES FOR 12 MAMMOGRAPHY; AND FOR OTHER PURPOSES. 13 14 15 Subtitle 16 TO INCREASE ACCESSIBILITY WHILE ENSURING 17 QUALITY FOR CERTAIN FACILITIES 18 PERFORMING MAMMOGRAPHY SERVICES; AND TO 19 AMEND THE LAW CONCERNING THE QUALITY 20 STANDARDS FOR ACCREDITATION OF 21 FACILITIES FOR MAMMOGRAPHY. 22 23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24 25 SECTION 1. Arkansas Code ยง 20 -15-1004(a), establishing quality 26 standards for accreditation of facilities for mammography, is amended to read 27 as follows: 28 (a)(1) The Secretary of the Department of Health shall establish 29 quality standards for accreditation of facilities wherein mammography may be 30 conducted in accordance with according to the Mammography Quality Standards 31 Act of 1992, Pub. L. No. 102 -539 (21 C.F.R. Part 900). 32 (2) The standards applicable to the physician who interprets 33 mammograms shall not be more stringent than those standards listed in the 34 Mammography Quality Standards Act of 1992, Pub. L. No. 102 -539 (21 C.F.R. 35 Part 900). 36 As Engrossed: H3/4/25 S4/7/25 HB1429 2 04-07-2025 11:18:06 ANS222 (3)(A) An interpreting physician is not required to be on site 1 but shall be immediately available via telecommunication to interpret 2 diagnostic mammography to adhere to the quality standard requirements under 3 subdivision (a)(2) of this section. 4 (B) A patient shall sign a waiver acknowledging that a 5 diagnostic evaluation performed via telemedicine or remotely may have 6 limitations compared to an in -person diagnostic evaluation. 7 (C) The results of the diagnostic evaluation shall be 8 provided to the patient before the patient leaves the facility after the 9 completion of the diagnostic evaluation. 10 11 SECTION 2. DO NOT CODIFY. Rule modification. 12 (a) The Department of Health shall modify all rules relating to 13 performing diagnostic mammography services and the accreditation of 14 facilities in which diagnostic mammography may be conducted to allow 15 interpreting physicians to be immediately available via telecommunication. 16 (b) The department shall remove a requirement to have the interpreting 17 physician physically on site for the performance of diagnostic mammography 18 services. 19 /s/M.
