Stricken language would be deleted from and underlined language would be added to present law. *TNL115* 02/15/2025 10:02:09 AM TNL115 State of Arkansas 1 95th General Assembly A Bill 2 Regular Session, 2025 HOUSE BILL 1492 3 4 By: Representative Gramlich 5 6 7 For An Act To Be Entitled 8 AN ACT TO REQUIRE EACH PUBLIC SCHOOL DISTRICT AND 9 OPEN-ENROLLMENT PUBLIC CHARTER SCHOOL TO PROVIDE ALL 10 SCHOOL EMPLOYEES WITH A WEARABLE PANIC ALERT SYSTEM 11 DEVICE; AND FOR OTHER PURPOSES. 12 13 14 Subtitle 15 TO REQUIRE EACH PUBLIC SCHOOL DISTRICT 16 AND OPEN-ENROLLMENT PUBLIC CHARTER 17 SCHOOL TO PROVIDE ALL SCHOOL EMPLOYEES 18 WITH A WEARABLE PANIC ALERT SYSTEM 19 DEVICE. 20 21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22 23 SECTION 1. Arkansas Code Title 6, Chapter 15, Subchapter 13, is 24 amended to add an additional section to read as follows: 25 6-15-1306. Wearable panic alert system — Required. 26 (a) Beginning with the 2025 -2026 school year, the board of directors 27 of each public school district and the governing authority of each open -28 enrollment public charter school shall implement a wearable panic alert 29 system in each public school within its public school district or open -30 enrollment public charter school system. 31 (b) The wearable panic alert system required under this section shall: 32 (1) Integrate with local Public Safety Answering Point 33 infrastructure to transmit 911 calls and mobile activations; and 34 (2) Initiate a campus -wide lockdown notification. 35 (c) Each public school district and open -enrollment public charter 36 HB1492 2 02/15/2025 10:02:09 AM TNL115 school shall provide each individual employed by the public school district 1 or open-enrollment public charter school with a wearable panic alert device 2 that allows the individual to immediately contact local emergency response 3 agencies. 4 (d) Before the first day of school of each school year, each public 5 school district board of directors and governing authority of an open -6 enrollment public charter school shall ensure that all school employees 7 receive training on the protocol for and appropriate use of the panic alert 8 device. 9 (e)(1) Each public school district and open -enrollment public charter 10 school shall: 11 (A) Ensure that all security data within the public school 12 district or open-enrollment public charter school is accessible by a local 13 law enforcement agency; and 14 (B) Coordinate with local law enforcement agencies to 15 establish appropriate access protocols with respect to security data. 16 (2) Accessible security under subdivision (e)(1) of this section 17 includes cameras, maps, and access control. 18 (f)(1) Any records, information, photographs, audio and visual 19 representations, schematic diagrams, surveys, recommendations, or 20 consultations or portions of consultations, that relate directly to the 21 physical security or fire safety of a public school district or an open -22 enrollment public charter school facility or reveal security or fire safety 23 systems that are accessed or held by a government agency are not public 24 records and not available for public inspection under the Freedom of 25 Information Act of 1967, § 25 -19-101 et seq. 26 (2) Information under subdivision (f)(1) of this section may be 27 disclosed: 28 (A) To the property owner or leaseholder of the public 29 school district or open -enrollment public charter school facility; 30 (B) In furtherance of the official duties and 31 responsibilities of the government agency that holds the information; 32 (C) To another local, state, or federal agency in 33 furtherance of that agency's official duties and responsibilities; or 34 (D) Upon a showing of good cause before a court of 35 competent jurisdiction. 36 HB1492 3 02/15/2025 10:02:09 AM TNL115 (g) The Department of Education may adopt rules to implement this 1 section. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
