AN ACT TO AMEND THE LAW CONCERNING THE ADMINISTRATION 9 
OF THE OATH OF OFFICE; AND FOR OTHER PURPOSES. 10

Subtitle 13 
TO AMEND THE LAW CONCERNING THE 14 
ADMINISTRATION OF THE OATH OF OFFICE. 15 
 16 
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17 
 18 
 SECTION 1.  Arkansas Code ยง 21-2-105(a), concerning who may administer 19 
an oath of office, is amended to read as follows: 20 
 (a)(1)  The Governor shall take the oath of office before: 21 
 (A)  A justice or judge of the: 22 
 (i)  Supreme Court; 23 
 (ii)  Court of Appeals; 24 
 (iii)  Circuit court; or 25 
 (iv)  District court; 26 
 (B)  The county clerk; or 27 
 (C)  The clerk of the circuit court. 28 
 (2)  The justices of the Supreme Court, judges of the Court of 29 
Appeals, judges of the circuit courts, judges of the district court, 30 
Secretary of State, Treasurer of State, and Auditor of State shall take their 31 
oaths before: 32 
 (A)  The Governor; 33 
 (B)  A justice or judge of the: 34 
 (i)  Supreme Court; 35 
 (ii)  Court of Appeals; 36    	HB1597

 (iii)  Circuit court , including any former circuit or 1 
chancery judge who served for at least four (4) years ; or 2 
 (iv)  District court , including any former municipal 3 
or district judge who served for at least four (4) years ; 4 
 (C)  The clerk of the county court; or 5 
 (D)  The clerk of the circuit court. 6 
 (3)  All other officers, both civil and military, shall take 7 
their oaths before: 8 
 (A)  The Secretary of State or his or her official 9 
designee; 10 
 (B)  A justice or judge of the: 11 
 (i)  Supreme Court; 12 
 (ii)  Court of Appeals; 13 
 (iii)  Circuit court , including any former circuit or 14 
chancery judge who served for at least four (4) years ; 15 
 (iv)  District court , including any former municipal 16 
or district judge who served for at least four (4) years ; or 17 
 (v)  County court; 18 
 (C)  The clerk of the county court; 19 
 (D)  The clerk of the circuit court; 20 
 (E)  A justice of the peace; 21 
 (F)  A clerk of a city of the first class; or 22 
 (G)  A recorder of a city of the second class or 23 
incorporated town. 24
