BY RISK-BASED PROVIDER ORGANIZATIONS; AND FOR OTHER 11
PURPOSES. 12

SEDATION DENTISTRY IS COVERED BY RISK -18
BASED PROVIDER ORGANIZATIONS. 19

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

SECTION 1. Arkansas Code § 20 -77-2703(6), concerning the definition of 23
"direct service provider" within the Medicaid Provider -Led Organized Care 24
Act, is amended to read as follows: 25
(6) “Direct service provider” means an organization or 26
individual that delivers healthcare services , including sedation dentistry, 27
to enrollable Medicaid beneficiary populations; 28

SECTION 2. Arkansas Code § 20 -77-2703, concerning definitions within 30
the Medicaid Provider -Led Organized Care Act, is amended to add an additional 31
subdivision to read as follows: 32
(15) "Sedation dentistry" means the administration of sedative 33
medications during dental procedures to address routine and complex dental 34
care needs, including minimal sedation, moderate sedation, deep sedation, and 35
general anesthesia. 36 HB1840

SECTION 3. Arkansas Code § 20 -77-2705(b), concerning the excluded 2
services under the Medicaid Provider -Led Organized Care Act, is amended to 3
read as follows: 4
(b) The Medicaid provider -led organized care system shall be 5
implemented to the extent possible, but shall not include the following 6
services when provided to enrollable Medicaid beneficiary populations: 7
(1) Nonemergency medical transportation in a capitated program; 8
(2) Dental benefits in a capitated program , not including 9
sedation dentistry; 10
(3) School-based services provided by school employees; 11
(4) Skilled nursing facility services; 12
(5) Assisted living facility services; 13
(6) Human development center services; or 14
(7) Waiver services provided to adults with physical 15
disabilities through the ARChoices in Homecare program or the Arkansas 16
IndependentChoices program. 17

SECTION 4. Arkansas Code § 20 -77-2706(f)(3), concerning the 19
characteristics and duties of a risk -based provider organization under the 20
Medicaid Provider-Led Organized Care Act, is amended to read as follows: 21
(3)(A) Process claims, including medical claims and dental 22
claims for sedation dentistry, or otherwise ensure payment to direct service 23
providers within time frames established under federal regulations for goods 24
and services delivered to the enrollable Medicaid beneficiary populations . 25
(B) Services provided by a risk -based provider 26
organization shall include medical and dental coverage for sedation dentistry 27
services; 28
