CONTENT GENERATED BY A GENERATIVE ARTIFICIAL 10 
INTELLIGENCE TOOL; AND FOR OTHER PURPOSES. 11

GENERATIVE ARTIFICIAL INTELLIGENCE TOOL. 17

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19 
 20 
 SECTION 1.  Arkansas Code Title 18, Chapter 4, Subchapter 1 is amended 21 
to add an additional section to read as follows: 22 
 18-4-101.  Generative artificial intelligence tool — Ownership of model 23 
training and generated content — Work made for hire — Exceptions. 24 
 (a)  Except as provided under subsection (b) of this section, when a 25 
person uses a generative artificial intelligence tool to: 26 
 (1)  Generate content, the person who provides the input or 27 
directive to the generative artificial intelligence tool shall be the owner 28 
of the generated content, provided that the content does not infringe on 29 
existing copyrights or intellectual property rights; 30 
 (2)  Conduct model training, the person who provides data or 31 
input to train a generative artificial intelligence model shall be the owner 32 
of the resulting trained model, provided that the: 33 
 (A)  Training data is lawfully acquired; and 34 
 (B)  Person has not transferred ownership rights through a 35

 (b)(1)  If an individual is employed by a person or entity and is 1 
directed to use a generative artificial intelligence tool to conduct model 2 
training or generate content as part of his or her employment duties, the 3 
resulting model training data and generated content shall be the property of 4 
the individual's employer. 5 
 (2)  Subdivision (b)(1) of this section shall apply only if the 6 
use of the generative artificial intelligence tool is: 7 
 (A)  Within the scope of the individual's employment; and 8 
 (B)  Conducted under the direction and control of the 9 
employer. 10 
 (c)  This section does not grant ownership over content that infringes 11 
on pre-existing copyrights or other intellectual property rights regardless 12 
of the use of a generative artificial intelligence tool. 13
