Shephard, Gonzales Worthen 6 7 8 For An Act To Be Entitled 9 AN ACT TO AMEND THE ARKANSAS HUMAN LIFE PROTECTION 10 ACT AND THE ARKANSAS UNBORN CHILD PROTECTION ACT TO 11 ADD EXCEPTIONS FOR A PREGNANCY THAT IS THE RESULT OF 12 INCEST OR RAPE, IN THE CASE OF A FETAL ABNORMALITY 13 INCOMPATIBLE WITH LIFE, AND TO SAVE THE HEALTH OF THE 14 MOTHER IN THE CASE OF A MEDICAL EMERGENCY; TO MODIFY 15 THE DEFINITION OF "MEDICAL EMERGENCY" WITHIN THE 16 ARKANSAS HUMAN LIFE PROTECTION ACT AND THE ARKANSAS 17 UNBORN CHILD PROTECTION ACT; AND FOR OTHER PURPOSES. 18 19 20 Subtitle 21 TO AMEND THE ARKANSAS HUMAN LIFE 22 PROTECTION ACT AND THE ARKANSAS UNBORN 23 CHILD PROTECTION ACT TO ADD CERTAIN 24 EXCEPTIONS. 25 26 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 27 28 SECTION 1. Arkansas Code § 5 -61-303(3), concerning the definition of 29 "medical emergency" within the Arkansas Human Life Protection Act, is amended 30 to read as follows: 31 (3) “Medical emergency” means a condition in which an abortion 32 is necessary to preserve the life or health of a pregnant woman whose life or 33 health is endangered by a physical disorder, physical illness, or physical 34 injury, including a life -endangering or health-endangering physical condition 35 caused by or arising from the pregnancy itself; and 36 HB1880 2 03/20/2025 1:54:53 PM JMB327 1 SECTION 2. Arkansas Code § 5 -61-304(a), concerning the prohibitions 2 under the Arkansas Human Life Protection Act, is amended to read as follows: 3 (a) A person shall not purposely perform or attempt to perform an 4 abortion except: 5 (1) To to save the life or health of a pregnant woman in a 6 medical emergency; 7 (2) When the pregnancy is the result of incest for which a 8 report has been filed with a law enforcement agency or prosecuting attorney's 9 office alleging the offense of incest, § 5 -26-202, or the sexual assault of a 10 minor; 11 (3) When the pregnancy is the result of a rape for which a 12 report has been filed with a law enforcement agency or prosecuting attorney's 13 office alleging the offense of rape, § 5 -14-103; or 14 (4) In the case of a fetal abnormality incompatible with life . 15 16 SECTION 3.
