TO PAY A COURT-ORDERED FINE; AND TO 21
AMEND THE LAW CONCERNING A DEFENDANT'S 22
INABILITY TO PAY A COURT -ORDERED FINE. 23

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25

SECTION 1. Arkansas Code § 16 -13-702(a)(5)(A), concerning the 27
immediate payment of a court imposed fine by a defendant, is amended to read 28
as follows: 29
(5)(A)(i) If the defendant claims an inability to pay the fine, 30
the court shall inquire into the defendant's ability to pay and shall make a 31
determination of the defendant's financial ability to pay the fine. 32
(ii) To assist the court in making a determination 33
of the defendant's financial ability to pay a fine under subdivision 34
(a)(5)(A)(i) of this section, the defendant shall provide to the court 35
information regarding the defendant's: 36 HB1926

(a) Monthly income; 1
(b) Monthly housing costs; 2
(c) Monthly utility costs; 3
(d) Monthly childcare costs; 4
(e) Monthly transportation costs; 5
(f) Monthly healthcare costs; 6
(g) Monthly tax liability; and 7
(h) Other necessary monthly costs. 8

SECTION 2. Arkansas Code § 16 -13-708(a), concerning the revocation, 10
suspension, or nonrenewal of a driver's license requested by a court from the 11
Department of Finance and Administration, is amended to add an additional 12
subdivision read as follows: 13
(4) When making a determination to request a revocation, 14
suspension, or nonrenewal of a person's driver's license under subdivision 15
(a)(1) of this section, the court shall consider the information provided 16
under § 16-13-702(a)(5)(A)(ii). 17

SECTION 3. Arkansas Code § 16 -13-708(b), concerning the revocation, 19
suspension, or nonrenewal of a driver's license requested by a court from the 20
Department of Finance and Administration, is amended to read as follows: 21
(b)(1) For a driver's license revocation, suspension, or nonrenewal, 22
the court must provide the department with the reason for the revocation, 23
suspension, or nonrenewal, the amount the person owes the court, and the 24
person's full name, date of birth, and last known address. 25
(2) If a person fails to provide the court with the information 26
required under § 16-13-702(a)(5)(A)(ii), the court shall include a 27
notification to the department of the person's failure to provide the 28
required information with the court's request for a driver's license 29
revocation, suspension, or nonrenewal. 30
