Act 914 of the Regular Session *TNL145* 04/01/2025 1:56:57 PM TNL145 State of Arkansas 1 95th General Assembly A Bill 2 Regular Session, 2025 HOUSE BILL 1966 3 4 By: Representative Barnett 5 6 7 For An Act To Be Entitled 8 AN ACT TO AUTHORIZE AN INCORPORATED TOWN OR A CITY OF 9 THE SECOND CLASS TO PETITION THE STATE BOARD OF 10 EDUCATION FOR THE ESTABLISHMENT OF A LOCAL PUBLIC 11 ELEMENTARY SCHOOL OR SATELLITE SCHOOL UNDER CERTAIN 12 CONDITIONS; AND FOR OTHER PURPOSES. 13 14 15 Subtitle 16 TO AUTHORIZE AN INCORPORATED TOWN OR A 17 CITY OF THE SECOND CLASS TO PETITION THE 18 STATE BOARD OF EDUCATION FOR THE 19 ESTABLISHMENT OF A LOCAL PUBLIC 20 ELEMENTARY SCHOOL OR SATELLITE SCHOOL 21 UNDER CERTAIN CONDITIONS. 22 23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24 25 SECTION 1. Arkansas Code Title 6, Chapter 13, Subchapter 14, is 26 amended to add an additional section to read as follows: 27 6-13-1419. Establishment of public elementary school — Required 28 following certain consolidations. 29 (a) An incorporated town or a city of the second class and the parents 30 of, legal guardians of, and persons standing in loco parentis to students 31 within an affected district may file a written appeal with a receiving 32 district board of directors for the establishment of a local public 33 elementary school or satellite school associated with an affected district's 34 existing school campus, to be located within the boundaries of the 35 incorporated town or city of the second class, if the: 36 HB1966 2 04/01/2025 1:56:57 PM TNL145 (1) Affected district included a public school that was 1 configured as an elementary school; 2 (2) Affected district is within the boundaries of the 3 incorporated town or city of the second class; 4 (3) Affected district resulted in a consolidation within the 5 last twenty (20) years from the effective date of this section; and 6 (3) Incorporated town or city of the second class has the means 7 of providing adequate school facilities. 8 (b) If a receiving school district board of directors approves the 9 written appeal of an incorporated town or a city of the second class under 10 subsection (a) of this section, the receiving school district board of 11 directors and the incorporated town or city of the second class shall jointly 12 file an appeal with the State Board of Education for the establishment of a 13 local public elementary school or satellite school associated with an 14 affected district's existing school campus, to be located within the 15 boundaries of the incorporated town or city of the second class. 16 (c)(1) A local public elementary school established in an affected 17 district under subsection (b) of this section shall be part of the receiving 18 district. 19 (2) The receiving district and the incorporated town or city of 20 the second class may enter into a written agreement for the provision of in -21 kind contributions from the incorporated town or city of the second class to 22 the receiving district for purposes of establishing and maintaining the local 23 public elementary school or satellite school established in the affected 24 district under this section. 25 26 27 APPROVED: 4/21/25 28 29 30 31 32 33 34 35 36
