TO AMEND THE RULES OF THE HOUSE OF REPRESENTATIVES OF 9
THE NINETY-FIFTH GENERAL ASSEMBLY; TO REQUIRE THAT 10
THE SPEAKER OF THE HOUSE OF REPRESENTATIVES SELECT A 11
MEMBER OF THE HOUSE OF REPRESENTATIVES AS A 12
DESIGNATED SURVIVOR; AND FOR OTHER PURPOSES. 13

GENERAL ASSEMBLY; TO REQUIRE THAT A 19
MEMBER OF THE HOUSE OF REPRESENTATIVES 20
BE SELECTED AS A DESIGNATED SURVIVOR. 21

BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE NINETY -FIFTH GENERAL 23
ASSEMBLY OF THE STATE OF ARKANSAS: 24

SECTION 1. Section 11. of the Rules of the House of Representatives, 26
concerning the duties of the Speaker of the House of Representatives, is 27
amended to add an additional section to read as follows: 28
11.(r)(1)(A) Appoint, before any joint meeting of the House of 29
Representatives and the Senate at which all members of the General Assembly 30
and the constitutional officers are invited, a member of the House of 31
Representatives to serve as the designated survivor. 32
(B) As used in this subsection, "designated survivor" 33
means a member of the House of Representatives who will succeed to the office 34
of the Speaker of the House of Representatives and in whom all powers, 35
duties, and emoluments of the office of the Speaker of the House of 36 HR1012

Representatives shall be bestowed in case of the death, illness, incapacity, 1
or other inability to serve of the Speaker of the House of Representatives 2
and a majority of the members of the House of Representatives. 3
(C) In case of the death, illness, incapacity, or other 4
inability to serve of the Speaker of the House of Representatives and a 5
majority of the members of the House of Representatives, the designated 6
survivor shall serve as Speaker of the House of Representatives until the 7
inability of the Speaker of the House of Representatives to serve is removed 8
or another individual is elected and qualified to the office of the Speaker 9
of the House of Representatives. 10
(D) A member selected to be the designated survivor shall 11
meet the following eligibility requirements: 12
(i) Have a seniority ranking in the top one third 13
(1/3) of the House of Representatives; and 14
(ii) Meet all qualifications to serve as Governor 15
under Arkansas Constitution, Article 6, § 5. 16
(2)(A) On the day of the joint meeting, the designated survivor 17
shall remove himself or herself from the State Capitol Building at least one 18
(1) hour before the start of the joint meeting to a location at least five 19
(5) miles away from the State Capitol Building and shall not return to the 20
State Capitol Building until at least one (1) hour after the conclusion of 21
the joint meeting. 22
(B)(i) The Speaker of the House of Representatives shall 23
notify the Division of Emergency Management of the appointment of the 24
designated survivor and work with the division on selection of an appropriate 25
location for the designated survivor during the joint meeting. 26
(ii) The location of the designated survivor on the 27
day of the joint meeting shall not be the designated survivor’s place of 28
residence. 29
(3)(A) If attendance is taken at the joint meeting, the 30
designated survivor shall be announced and counted as present at the joint 31
meeting and any other meeting of a legislative body of which he or she is a 32
member that is held on the day of the joint meeting. 33
(B) The designated survivor shall count towards a quorum 34
at any meeting of a legislative body of which he or she is a member that is 35
held on the day of the joint meeting. 36 HR1012

(C) The designated survivor is eligible for mileage and 1
per diem related to his or her service as the designated survivor. 2
