The Deputy Director of the Livestock and Poultry Commission, 20 with prior approval of the Arkansas Legislative Council or the Joint Budget 21 Committee, the approval of the Chief Fiscal Officer of the State, and for the 22 reimbursing of documented expenditures designated by law to be made from the 23 transferred special revenue, may transfer funds among the Livestock and 24 Poultry Equine Infectious Anemia Control Fund, Livestock and Poultry 25 Commission Disease and Pest Control Fund, Livestock and Poultry Special 26 Revenue Fund, Livestock and Poultry Commission Swine Testing Fund, and the 27 Poultry and Egg Grading Fund or from these funds to the Livestock and Poultry 28 Fund Account. The purpose of these transfers shall only be for accurate 29 allocation of incurred costs between the funds. Requests for fund transfer 30 will at least include the total amount to be transferred, to and from which 31 funds, the nature, purpose, and time period of the expenditures being 32 reimbursed, and any other information requested by the Legislative Council or 33 the Joint Budget Committee. 34 Determining the maximum number of employees and the maximum amount of 35 appropriation and general revenue funding for a state agency each fiscal year 36 As Engrossed: S1/29/25 S3/31/25 SB106 33 03-31-2025 17:32:01 BSS012 is the prerogative of the General Assembly. If the State Forestry Commission determines that 13 temporary firefighters, dispatchers, or pilots are required to meet the 14 demands of a wildfire season, and upon approval of the Chief Fiscal Officer 15 of the State, appropriations may be transferred from either Extra Help or 16 Professional Fees and Services to the proper character code for the 17 employment of such personnel. 18 If the State Forestry Commission determines that the deployment of air 19 tankers for fighting wildfires requires additional Professional Fees and 20 Services, and upon the approval of the Chief Fiscal Officer of the State, 21 excess appropriation in Regular Salaries or Personal Services Matching may be 22 transferred to Professional Fees and Services in the Operations and Forestry 23 - Rural Community Fire Protection - Federal appropriation sections. 24 If the State Forestry Commission determines that the most effective way for 25 it to cooperate in the growing and distribution of forest planting stock is 26 by contracting work with private vendors and/or hiring temporary employees 27 for seasonal work, the Commission is hereby authorized, upon approval by the 28 Chief Fiscal Officer of the State, to transfer the necessary appropriation 29 authorized for Extra Help and Maintenance and General Operation in the 30 Operations and Forestry - Rural Community Fire Protection - Federal 31 appropriation sections. 32 The provisions of this section shall be in effect only from July 1, 2024 33 2025 through June 30, 2025 2026. 34 35 SECTION 63. Notwithstanding any law pertaining to the transfer of year -end fund 12 balances or any law to the contrary, any funds up to $500,000 which remain in 13 the Department of Agriculture Fund Account at the end of a fiscal year shall 14 remain in the Department of Agriculture Fund Account and be made available to 15 fund appropriation(s) authorized by law to be made for maintenance and 16 operating costs associated with wildfire suppression, as well as the purchase 17 of fire suppression equipment for the Forestry Division and made payable from 18 the Department of Agriculture Fund Account for the following fiscal year. 19 Any carry forward of unexpended balance of funding up to $500,000 as 20 authorized herein, may be carried forward under the following conditions: 21 (1) Prior to June 30, 2026, the Agency shall by written statement set forth 22 its reason(s) for the need to carry forward said funding to the Department of 23 Finance and Administration Office of Budget; 24 (2) The Department of Finance and Administration Office of Budget shall 25 report to the Arkansas Legislative Council or Joint Budget Committee all 26 amounts carried forward by the September Arkansas Legislative Council or 27 Joint Budget Committee meeting which report shall include the name of the 28 Agency, Board, Commission or Institution and the amount of the funding 29 carried forward, from the first fiscal year to the second fiscal year, the 30 program name or line item, the funding source of that appropriation and a 31 copy of the written request set forth in (1) above: 32 (3) Each Agency, Board, Commission or Institution shall provide a written 33 report to the Arkansas Legislative Council or Joint Budget Committee 34 containing all information set forth in item (2) above, along with a written 35 statement as so the current status of the project, contract, purpose etc. for 36 As Engrossed: S1/29/25 S3/31/25 SB106 36 03-31-2025 17:32:01 BSS012 which the carry forward was originally requested no later than thirty (30) 1 days prior to the time the Agency, Board, Commission or Institution presents 2 its budget request to the Arkansas Legislative Council/Joint Budget 3 Committee; and 4 (4) Thereupon, the Department of Finance and Administration shall include 5 all information obtained in item (3) above in the budget manuals and/or a 6 statement of noncompliance by the Agency, Board, Commission or Institution. 7 The provisions of this section shall be in effect only from July 1, 2025 8 through June 30, 2026. 9 10 SECTION 65. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 12 TRANSFER. (A)(1) If the Arkansas Department of Agriculture determines 13 additional funding is required to support the purchase of firefighting 14 equipment and forest fire suppression activities, to include the maintenance 15 and operations costs associated with fire suppression, the Department of 16 Agriculture with prior approval of the Chief Fiscal Officer of the State, may 17 transfer the sum of one million one hundred eighty thousand one hundred 18 dollars ($1,180,100) of the amount authorized for transfer by Act 154 of 19 2012, to the State Forestry Fund. 20 (2) The transfer authority provided to the department in subdivision (A)(1) 21 of this section may be used in furtherance of the State Forestry Trust 22 Program. 23 (3) The provisions of this section shall be in effect only from July 1, 2025 24 through June 30, 2026. 25 26 SECTION 66. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 27 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 28 REALLOCATION OF RESOURCES. The Department of Agriculture provides a wide 29 range of services to all Arkansans. The specific service needs, along with 30 staffing required to meet them, can vary significantly due to factors such as 31 natural disasters, changing federal mandates, and job market variations like 32 wildland firefighters, dispatchers, foresters, engineers, and 33 microbiologists' shortages. These factors make it challenging for the 34 Department to accurately predict the exact needs for positions across its 35 different appropriations throughout any fiscal year. To respond swiftly to 36 As Engrossed: S1/29/25 S3/31/25 SB106 37 03-31-2025 17:32:01 BSS012 changing needs and to utilize resources effectively, the Department of 1 Agriculture is authorized to reallocate resources as necessary. Upon 2 determining that a reallocation is essential for the efficient and effective 3 operation of the department, the Secretary of the Department of Agriculture, 4 with the approval of the Chief Fiscal Officer of the State and Legislative 5 Council or the Joint Budget Committee, if meeting in Legislative Session, may 6 request to transfer positions between existing business areas of the 7 department. Transfer authority shall be limited to no more than 5% of the 8 total authorized department positions in any fiscal year. 9 Determining the maximum number of employees and the maximum amount of 10 appropriation and general revenue funding for a state agency each fiscal year 11 is the prerogative of the General Assembly. This is usually accomplished by 12 delineating such maximums in the appropriation act(s) for a state agency and 13 the general revenue allocations authorized for each fund and fund account by 14 amendment to the Revenue Stabilization law. Further, the General Assembly has 15 determined that the Department of Agriculture may operate more efficiently if 16 some flexibility is provided to the Department of Agriculture authorizing 17 broad powers under the Reallocation of Resources provisions herein. 18 Therefore, it is both necessary and appropriate that the General Assembly 19 maintain oversight by requiring prior approval of the Legislative Council or 20 Joint Budget Committee as provided by this section. The requirement of 21 approval by the Legislative Council or Joint Budget Committee is not a 22 severable part of this section. If the requirement of approval by the 23 Legislative Council or Joint Budget Committee is ruled unconstitutional by a 24 court jurisdiction, this entire section is void. 25 The provisions of this section shall be in effect only from July 1, 2025, 26 through June 30, 2026. 27 28 SECTION 67. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 29 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 30 TRANSFER PROVISION- NRC. At the end of each fiscal year, the Chief Fiscal 31 Officer of the State shall authorize the transfer of obligated water, sewer, 32 and solid waste funds, as provided in the appropriation act for the Natural 33 Resources Commission in the appropriation entitled "Water, Sewer and Solid 34 Waste - State", from the Miscellaneous Agencies Fund Account, to the Water, 35 Sewer and Solid Waste Revolving Fund. 36 As Engrossed: S1/29/25 S3/31/25 SB106 38 03-31-2025 17:32:01 BSS012 The provisions of this section shall be in effect only from July 1, 2024 1 2025 through June 30, 2025 2026. 2 3 SECTION 68. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 4 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 5 FORWARD - NRC. At the end of each fiscal year, the Chief Fiscal Officer of 6 the State shall authorize the carry forward of funds to support the amount of 7 obligated grants that are certified by the Natural Resources Commission for 8 Matching Grants in the appropriation entitled "Water Quality Plan 9 Implementation". 10 Any carry forward of unexpended balance of funding as authorized herein, may 11 be carried forward under the following conditions: 12 (1) Prior to June 30, 2025 2026 the Agency shall by written statement set 13 forth its reason(s) for the need to carry forward said funding to the 14 Department of Finance and Administration Office of Budget; 15 (2) The Department of Finance and Administration Office of Budget shall 16 report to the Arkansas Legislative Council all amounts carried forward by the 17 September Arkansas Legislative Council or Joint Budget Committee meeting 18 which report shall include the name of the Agency, Board, Commission or 19 Institution and the amount of the funding carried forward from the first 20 fiscal year to the second fiscal year, the program name or line item, the 21 funding source of that appropriation and a copy of the written request set 22 forth in (1) above; 23 (3) Each Agency, Board, Commission or Institution shall provide a written 24 report to the Arkansas Legislative Council or Joint Budget Committee 25 containing all information set forth in item (2) above, along with a written 26 statement as to the current status of the project, contract, purpose etc. for 27 which the carry forward was originally requested no later than thirty (30) 28 days prior to the time the Agency, Board, Commission or Institution presents 29 its budget request to the Arkansas Legislative Council/Joint Budget 30 Committee; and 31 (4) Thereupon, the Department of Finance and Administration shall include 32 all information obtained in item (3) above in the budget manuals and/or a 33 statement of non-compliance by the Agency, Board, Commission or Institution. 34 The provisions of this section shall be in effect only from July 1, 2024 35 2025 through June 30, 2025 2026. 36 As Engrossed: S1/29/25 S3/31/25 SB106 39 03-31-2025 17:32:01 BSS012 1 SECTION 69. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 1 authorized by this act shall be limited to the appropriation for such agency 2 and funds made available by law for the support of such appropriations; and 3 the restrictions of the State Procurement Law, the General Accounting and 4 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 5 Procedures and Restrictions Act, or their successors, and other fiscal 6 control laws of this State, where applicable, and regulations promulgated by 7 the Department of Finance and Administration, as authorized by law, shall be 8 strictly complied with in disbursement of said funds. 9 10 SECTION 71. LEGISLATIVE INTENT. It is the intent of the General 11 Assembly that any funds disbursed under the authority of the appropriations 12 contained in this act shall be in compliance with the stated reasons for 13 which this act was adopted, as evidenced by the Agency Requests, Executive 14 Recommendations and Legislative Recommendations contained in the budget 15 manuals prepared by the Department of Finance and Administration, letters, or 16 summarized oral testimony in the official minutes of the Arkansas Legislative 17 Council or Joint Budget Committee which relate to its passage and adoption. 18 19 SECTION 72. EMERGENCY CLAUSE. It is found and determined by the 20 General Assembly, that the Constitution of the State of Arkansas prohibits 21 the appropriation of funds for more than a one (1) year period; that the 22 effectiveness of this Act on July 1, 2025 is essential to the operation of 23 the agency for which the appropriations in this Act are provided, and that in 24 the event of an extension of the legislative session, the delay in the 25 effective date of this Act beyond July 1, 2025 could work irreparable harm 26 upon the proper administration and provision of essential governmental 27 programs.
