NOT TO BE INCORPORATED INTO THE ARKANSAS 20 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PINE TREE 21 RESEARCH STATION. 22 (a) The Board of Trustees of the University of Arkansas shall not sell 23 the property commonly known as the Pine Tree Research Station, located in St. 24 Francis County, Arkansas, which was acquired by the Board of Trustees of the 25 University of Arkansas from the United States of America acting through the 26 Forest Service in 1978, to a private entity or individual. 27 (b) The Board of Trustees of the University of Arkansas may sell the 28 property commonly known as the Pine Tree Research Station, located in St. 29 Francis County, Arkansas, which was acquired by the Board of Trustees of the 30 University of Arkansas from the United States of America acting through the 31 Forest Service in 1978, to: 32 (1) A non-profit corporation organized with the primary mission 33 to keep the land open to the public and available for public use; and 34 (2) Organized and operated for a minimum of five (5) years. 35 (c) The property commonly known as the Pine Tree Research Station, 36 SB124 9 01/27/2025 2:09:43 PM HAR041 located in St. Francis County, Arkansas, which was acquired by the Board of 1 Trustees of the University of Arkansas from the United States of America 2 acting through the Forest Service in 1978, shall remain open to the public 3 for public use, including without limitation: 4 (1) Public fishing; 5 (2) Public hunting; 6 (3) Biking; 7 (4) Bird watching; and 8 (5) Hiking. 9 (d) All property commonly known as the Pine Tree Research Station, 10 located in St. Francis County, Arkansas, which was acquired by the Board of 11 Trustees of the University of Arkansas from the United States of America 12 acting through the Forest Service in 1978, in row crop cultivation in the 13 year 2020 is exempt from subsection (c) of this section. 14 The provisions of this section shall be in effect only from July 1, 2024 15 2025 through June 30, 2025 2026. 16 17 SECTION 7. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 18 authorized by this act shall be limited to the appropriation for such agency 19 and funds made available by law for the support of such appropriations; and 20 the restrictions of the State Procurement Law, the General Accounting and 21 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 22 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 23 Act, or their successors, and other fiscal control laws of this State, where 24 applicable, and regulations promulgated by the Department of Finance and 25 Administration, as authorized by law, shall be strictly complied with in 26 disbursement of said funds. 27 28 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General 29 Assembly that any funds disbursed under the authority of the appropriations 30 contained in this act shall be in compliance with the stated reasons for 31 which this act was adopted, as evidenced by the Agency Requests, Executive 32 Recommendations and Legislative Recommendations contained in the budget 33 manuals prepared by the Department of Finance and Administration, letters, or 34 summarized oral testimony in the official minutes of the Arkansas Legislative 35 Council or Joint Budget Committee which relate to its passage and adoption. 36 SB124 10 01/27/2025 2:09:43 PM HAR041 1 SECTION 9. EMERGENCY CLAUSE. It is found and determined by the General 2 Assembly, that the Constitution of the State of Arkansas prohibits the 3 appropriation of funds for more than a one (1) year period; that the 4 effectiveness of this Act on July 1, 2025 is essential to the operation of 5 the agency for which the appropriations in this Act are provided, and that in 6 the event of an extension of the legislative session, the delay in the 7 effective date of this Act beyond July 1, 2025 could work irreparable harm 8 upon the proper administration and provision of essential governmental 9 programs.
