FUNDING 1 TRANSFER NCI DESIGNATION TRUST FUND. (i) From time to time at the request of 2 the Chancellor of the University of Arkansas for Medical Sciences or his or 3 her designee, the Chief Fiscal Officer of the State shall transfer on his or 4 her books and those of the State Treasurer and the Auditor of the State funds 5 from the University of Arkansas Medical Center Fund or from cash funds 6 payable from the Appropriation – Cash Funds in this Act to the National 7 Cancer Institute Designation Trust Fund. (ii) No fund transfer authorized in 8 subsection (i) herein shall be implemented until the Chief Fiscal Officer of 9 the State has determined sufficient funding is available to be transferred, 10 and the transfer has received prior review by the Arkansas Legislative 11 Council or, if meeting in Regular or Fiscal Session, the Joint Budget 12 Committee. 13 The provisions of this section shall be in effect only from July 1, 2024 14 2025 through June 30, 2025 2026. 15 16 SECTION 27. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 17 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. DOMESTIC 18 VIOLENCE SHELTER GRANTS. The grants authorized in the Domestic Violence 19 Shelter Programs and Grants appropriation section of this act shall be 20 equally distributed to domestic violence shelters as determined by the 21 Arkansas Child Abuse/Rape/Domestic Violence Commission. The Arkansas Child 22 Abuse/Rape/Domestic Violence Commission may adopt rules and regulations to 23 carry out the intent of the General Assembly regarding the grant 24 appropriations authorized in the Domestic Violence Shelter Programs and 25 Grants appropriation section of this act. 26 The provisions of this section shall be in effect only from July 1, 2024 27 2025 through June 30, 2025 2026. 28 29 SECTION 28. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 30 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. MEDICAL 31 SCHOOL LIMITATION. Nothing in this Act shall create an additional medical 32 school in the State of Arkansas, but it recognizes that appropriations, 33 funding and allocations in this Act may be used by the University of Arkansas 34 for Medical Sciences to support satellite campuses or programs outside the 35 City of Little Rock in order to conduct or continue training of its medical, 36 SB128 22 01/27/2025 2:23:03 PM HAR039 nursing, pharmacy and allied health students, as well as its medical 1 residents. 2 The provisions of this section shall be in effect only from July 1, 2024 3 2025 through June 30, 2025 2026. 4 5 SECTION 29. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 6 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS 7 CHILDREN'S HOSPITAL AND TRANSFER AUTHORIZED. Thirty -three and one-third 8 percent (33-1/3%), in each fiscal year, of the amounts made available to fund 9 the appropriation in the Grants to Children's Hospital, Regular Salaries and 10 Operating Expenses for Indigent Care line item of the Operations 11 appropriation section of this Act shall be distributed to the Arkansas 12 Children's Hospital or Arkansas Children's Hospital may request that the 13 University of Arkansas for Medical Sciences transfer such funds each fiscal 14 year from the University of Arkansas Medical Center Fund to the Department of 15 Human Services Grants Fund Account. The transferred funds shall be used to 16 match federal funds used for supplemental Medicaid payments to Arkansas 17 Children's Hospital. 18 The provisions of this section shall be in effect only from July 1, 2024 19 2025 through June 30, 2025 2026. 20 21 SECTION 30. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. DAY CARE. 23 Of the funds appropriated in the Operations appropriation section of this 24 Act, $250,000 each year may be allocated as the State's portion of the 25 operating cost of a Child Care Facility of the University of Arkansas for 26 Medical Sciences. Individuals using this facility will be charged a daily 27 rate as determined by the University of Arkansas for Medical Sciences. 28 The provisions of this section shall be in effect only from July 1, 2024 29 2025 through June 30, 2025 2026. 30 31 SECTION 31. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 33 FORWARD. Any unexpended balance of the general revenue funds provided by this 34 Act which remains at the close of a fiscal year, not to exceed ten percent 35 (10%) of funded appropriations, shall be carried forward and made available 36 SB128 23 01/27/2025 2:23:03 PM HAR039 for the same purposes for the next fiscal year. 1 Any carry forward of unexpended balance of funding as authorized herein, 2 may be carried forward under the following conditions: 3 (1) Prior to June 30, 2025 2026 the Agency shall by written statement set 4 forth its reason(s) for the need to carry forward said funding to the 5 Department of Finance and Administration Office of Budget; 6 (2) The Department of Finance and Administration Office of Budget shall 7 report to the Arkansas Legislative Council all amounts carried forward by the 8 September Arkansas Legislative Council or Joint Budget Committee meeting 9 which report shall include the name of the Agency, Board, Commission or 10 Institution and the amount of the funding carried forward, the program name 11 or line item, the funding source and a copy of the written request set forth 12 in (1) above; 13 (3) Each Agency, Board, Commission or Institution shall provide a written 14 report to the Arkansas Legislative Council or Joint Budget Committee 15 containing all information set forth in item (2) above, along with a written 16 statement as to the current status of the project, contract, purpose, etc. 17 for which the carry forward was originally requested no later than thirty 18 (30) days prior to the time the Agency, Board, Commission or Institution 19 presents its budget request to the Arkansas Legislative Council/Joint Budget 20 Committee; and 21 (4) Thereupon, the Department of Finance and Administration shall include 22 all information obtained in item (3) above in the budget manuals and/or a 23 statement of non-compliance by the Agency, Board, Commission or Institution. 24 The provisions of this section shall be in effect only from July 1, 2024 25 2025 through June 30, 2025 2026. 26 27 SECTION 32. NOT TO BE INCORPORATED INTO THE ARKANSAS 9 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 10 ESTABLISHMENT OF A "GROWTH POOL". (a) The Arkansas Division of Higher 11 Education shall establish and maintain for the 2024-2025 2025-2026 fiscal 12 year a pool of three six hundred (300 600) non-classified positions . A 13 position established under this section shall not exceed the salary rate of 14 the highest maximum annual salary rate authorized by the General Assembly in 15 the institution's appropriation act. These positions are to be used by the 16 University of Arkansas for Medical Sciences in the event that the personal 17 services needs of the University during the 2024-2025 2025-2026 fiscal year 18 exceed the number of positions allocated to the University by the 19 Legislature. The University shall provide justification to the Arkansas 20 Division of Higher Education for the need to allocate titles from this 21 "growth pool". No classifications titles will be assigned to the pool until 22 such time as specific positions are requested by the University, approved by 23 the University Board or their designee, and approved by the Legislative 24 Council or Joint Budget Committee. Furthermore, the Arkansas Division of 25 Higher Education shall establish and maintain for the 2024-2025 fiscal year a 26 pool of three hundred (300) career service positions up to a C130. These 27 positions are to be used by the University of Arkansas for Medical Sciences 28 in the event that the personal services needs of the University during the 29 2024-2025 fiscal year exceed the number of positions in a classification 30 allocated to the University by the Legislature. The University shall provide 31 justification to the Arkansas Division of Higher Education for the need to 32 allocate titles from this "growth pool". No classifications will be assigned 33 to the pool until such time as specific positions are requested by the 34 University, recommended by the Arkansas Division of Higher Education, and 35 approved by the Legislative Council or Joint Budget Committee. 36 SB128 25 01/27/2025 2:23:03 PM HAR039 (b) Determining the number of personnel to be employed by a state agency 1 is the prerogative of the General Assembly and is usually accomplished by 2 delineating the maximum number of personnel by identifying the job titles and 3 the maximum grade or salary attached to those salaries. The General Assembly 4 has determined that the University of Arkansas for Medical Sciences could be 5 operated more efficiently if some flexibility is given to that institution. 6 That flexibility is being accomplished by providing growth pools in 7 subsection (a) of this section and since the General Assembly has granted the 8 institution broad powers under the growth pool concept, it is both necessary 9 and appropriate that the General Assembly maintain oversight of the 10 utilization of the growth pool by requiring prior approval of the Legislative 11 Council or Joint Budget Committee in the utilization of the growth pool. 12 Therefore, the requirement of approval by the Legislative Council or Joint 13 Budget Committee is not a severable part of this section. If the requirement 14 of approval by the Legislative Council or Joint Budget Committee is ruled 15 unconstitutional by a court of competent jurisdiction, this entire section is 16 void. 17 If the agency requests continuation of a "Growth Pool" position(s) as 18 established herein during the next fiscal year, the position(s) must be 19 requested as a new position(s) in the agency's budget request. 20 The provisions of this section shall be in effect only from July 1, 2024 21 2025 through June 30, 2025 2026. 22 23 SECTION 34. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 24 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CHILD 25 HEALTH AND FAMILY LIFE INSTITUTE. The Child Health and Family Life Institute 26 shall be administered under the direction of Arkansas Children’s Hospital. 27 Arkansas Children’s Hospital shall enter into a cooperative agreement and/or 28 contract with the University of Arkansas for Medical Sciences -Department of 29 Pediatrics for services required to deliver the programs of the Child Health 30 and Family Life Institute (CHFLI). Utilizing a multidisciplinary 31 collaboration of professionals, CHFLI shall provide a statewide effort to 32 explore, develop and evaluate new and better ways to address medically, 33 socially and economically interrelated health and developmental needs of 34 children with special health care needs and their families. CHFLI priorities 35 shall include, but are not limited to, wellness and prevention, screening and 36 SB128 26 01/27/2025 2:23:03 PM HAR039 diagnosis, treatment and intervention, training and education and research 1 and evaluation. Arkansas Children’s Hospital and the University of Arkansas 2 for Medical Sciences -Department of Pediatrics shall make annual reports to 3 the Arkansas Legislative Council on all matters of funding, existing programs 4 and services offered through CHFLI. 5 The provisions of this section shall be in effect only from July 1, 2024 6 2025 through June 30, 2025 2026. 7 8 SECTION 35. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 9 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PARKING 10 FEES. On July 1 of each year the University of Arkansas for Medical Sciences 11 shall pay from the appropriation provided herein from non -general revenue, 12 the total amount appropriated for War Memorial Parking Services from Fees to 13 War Memorial. 14 The provisions of this section shall be in effect only from July 1, 2024 15 2025 through June 30, 2025 2026. 16 17 SECTION 36. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 18 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 19 PROVISIONS. Because the Rural Medical Practice Student Loan and Scholarship 20 Program Loans and/or Scholarships and the Community Match Student Loan and 21 Scholarship Program Loans and/or Scholarships have the goal of providing 22 primary care physicians in rural Arkansas, transfers may be made in such 23 amounts as are required between the line items made in the appropriation for 24 "Medical Loans and Scholarships". 25 The provisions of this section shall be in effect only from July 1, 2024 26 2025 through June 30, 2025 2026. 27 28 SECTION 37. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 29 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CLINICAL 30 EXPANSION AND RESEARCH POOL. (a) In order to address personnel needs emerging 31 from expanding medical research and patient care issues and the necessity of 32 recruiting and retaining qualified medical, research, and related support 33 personnel, the University of Arkansas for Medical Sciences or its successor 34 is authorized for the 2024-2025 2025-2026 fiscal year a pool of seven hundred 35 (700) "Clinical Expansion and Research Pool" positions. These positions are 36 SB128 27 01/27/2025 2:23:03 PM HAR039 to be used by the University of Arkansas for Medical Sciences in the event 1 that the personal services needs resulting from unanticipated clinical or 2 research programs that are initiated during the 2024-2025 2025-2026 fiscal 3 year require additional positions, either in title, in classification, or in 4 number, that are not authorized or contemplated by the General Assembly in 5 the Regular Salaries - Operations section of this Act. 6 (b) The University of Arkansas for Medical Sciences is authorized to 7 access the "Clinical Expansion and Research Pool" positions authorized in 8 this Section at any time during the fiscal year when it is determined by the 9 Chancellor of the University of Arkansas for Medical Sciences, subject to the 10 review and approval by the Board of Trustees, that the need for additional 11 positions exists. Only medical or research positions shall be established 12 under this provision. The Chancellor of the University of Arkansas for 13 Medical Sciences shall provide a quarterly report detailing the justification 14 of allocation of positions from this "Clinical Expansion and Research Pool" 15 to the Chief Fiscal Officer of the State, to the Arkansas Division of Higher 16 Education, and to the Arkansas Legislative Council or Joint Budget Committee 17 for review. The report shall also include an accounting of the names, titles 18 and salaries of personnel who have been employed in positions established 19 from this pool and the source and duration of funds associated with the 20 positions. 21 (c) If the University of Arkansas for Medical Sciences requests 22 continuation of any "Clinical Expansion and Research Pool" position(s) as 23 established herein during the next fiscal year, the position(s) must be 24 requested as a new position(s) in the agency's budget request. 25 (d) Determining the number of personnel to be employed by a state agency 26 is the prerogative of the General Assembly and is usually accomplished by 27 delineating the maximum number of personnel by identifying job titles and the 28 maximum grade or salary attached to those titles. The General Assembly has 29 determined that the University of Arkansas for Medical Sciences could be 30 operated more efficiently if some flexibility is given to that institution. 31 That flexibility is being accomplished by providing a position pool in 32 Subsection (a) of this Section and since the General Assembly has granted the 33 agency broad powers under the growth pool concept, it is both necessary and 34 appropriate that the General Assembly maintain oversight of the utilization 35 of the position pool by requiring review of the Legislative Council or Joint 36 SB128 28 01/27/2025 2:23:03 PM HAR039 Budget Committee in the utilization of the position pool. Therefore, the 1 requirement of review by the Legislative Council or Joint Budget Committee is 2 not a severable part of this section. If the requirement of review by the 3 Legislative Council or Joint Budget Committee is ruled unconstitutional by a 4 court of competent jurisdiction, this entire section is void. 5 The provisions of this section shall be in effect only from July 1, 2024 6 2025 through June 30, 2025 2026. 7 8 SECTION 38. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 9 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ABUSED 10 CHILDREN AND ADOLESCENTS SERVICES PROGRAM FUNDING PROVISION. In the event 11 the amount of general revenue distributed to the University of Arkansas 12 Medical Center Fund for the Department of Pediatrics and the Psychiatric 13 Research Institute each fiscal year is at least equal to the amount 14 distributed during the 2012 -13 fiscal year, an amount not less than seven 15 hundred thousand dollars ($700,000) shall be allocated and made available as 16 follows: four hundred fifty thousand dollars ($450,000) each fiscal year 17 shall be made available exclusively to support the purposes and goals to 18 improve screening, monitoring and care for abused children and adolescents 19 through the Child Safety Centers or the University of Arkansas for Medical 20 Sciences as referred by the Child Safety Centers. Maintenance of statewide 21 screening and assessment protocols as well as evidence -based training of 22 mental health professionals are to be considered critical components of the 23 overall goals. For the provision of assessment and therapeutic services, 24 these funds are to be provided to the Child Safety Centers through contracts 25 from the University of Arkansas for Medical Sciences. The contracts will 26 stipulate the terms of the agreement and reporting requirements; an amount 27 not to exceed fifty thousand dollars ($50,000) may be utilized for 28 administrative costs as may be necessary to administer the program or if 29 determined not to be needed for administrative costs may be placed in reserve 30 for future needs of the program. The remaining two hundred thousand dollars 31 ($200,000) shall be allocated and made available to the Department of 32 Pediatrics for expenses for medical examinations, consultation, education and 33 training as stipulated in the terms of agreement between the Chancellor of 34 the University of Arkansas for Medical Sciences and the Department of 35 Pediatrics. 36 SB128 29 01/27/2025 2:23:03 PM HAR039 The provisions of this section shall be in effect only from July 1, 2024 1 2025 through June 30, 2025 2026. 2 3 SECTION 39. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 4 authorized by this act shall be limited to the appropriation for such agency 5 and funds made available by law for the support of such appropriations; and 6 the restrictions of the State Procurement Law, the General Accounting and 7 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 8 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 9 Act, or their successors, and other fiscal control laws of this State, where 10 applicable, and regulations promulgated by the Department of Finance and 11 Administration, as authorized by law, shall be strictly complied with in 12 disbursement of said funds. 13 14 SECTION 40. LEGISLATIVE INTENT. It is the intent of the General 15 Assembly that any funds disbursed under the authority of the appropriations 16 contained in this act shall be in compliance with the stated reasons for 17 which this act was adopted, as evidenced by the Agency Requests, Executive 18 Recommendations and Legislative Recommendations contained in the budget 19 manuals prepared by the Department of Finance and Administration, letters, or 20 summarized oral testimony in the official minutes of the Arkansas Legislative 21 Council or Joint Budget Committee which relate to its passage and adoption. 22 23 SECTION 41. EMERGENCY CLAUSE. It is found and determined by the 24 General Assembly, that the Constitution of the State of Arkansas prohibits 25 the appropriation of funds for more than a one (1) year period; that the 26 effectiveness of this Act on July 1, 2025 is essential to the operation of 27 the agency for which the appropriations in this Act are provided, and that in 28 the event of an extension of the legislative session, the delay in the 29 effective date of this Act beyond July 1, 2025 could work irreparable harm 30 upon the proper administration and provision of essential governmental 31 programs. Therefore, an emergency is hereby declared to exist and this Act 32 being necessary for the immediate preservation of the public peace, health 33 and safety shall be in full force and effect from and after July 1, 2025. 34 35 36
