(ii) No fund transfer authorized in 22 subsection (i) herein shall be implemented until the Chief Fiscal Officer of 23 the State has determined sufficient funding is available to be transferred, 24 and the transfer has received prior review by the Arkansas Legislative 25 Council or, if meeting in Regular or Fiscal Session, the Joint Budget 26 Committee. 27 The provisions of this section shall be in effect only from July 1, 2024 28 2025 through June 30, 2025 2026. 29 30 SECTION 21. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 31 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. DOMESTIC 32 VIOLENCE SHELTER GRANTS. The grants authorized in the Domestic Violence 33 Shelter Programs and Grants appropriation section of this act shall be 34 equally distributed to domestic violence shelters as determined by the 35 Arkansas Child Abuse/Rape/Domestic Violence Commission. The Arkansas Child 36 As Engrossed: S3/17/25 SB128 19 03-17-2025 16:22:29 HAR039 Abuse/Rape/Domestic Violence Commission may adopt rules and regulations to 1 carry out the intent of the General Assembly regarding the grant 2 appropriations authorized in the Domestic Violence Shelter Programs and 3 Grants appropriation section of this act. 4 The provisions of this section shall be in effect only from July 1, 2024 5 2025 through June 30, 2025 2026. 6 7 SECTION 22. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 8 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. MEDICAL 9 SCHOOL LIMITATION. Nothing in this Act shall create an additional medical 10 school in the State of Arkansas, but it recognizes that appropriations, 11 funding and allocations in this Act may be used by the University of Arkansas 12 for Medical Sciences to support satellite campuses or programs outside the 13 City of Little Rock in order to conduct or continue training of its medical, 14 nursing, pharmacy and allied health students, as well as its medical 15 residents. 16 The provisions of this section shall be in effect only from July 1, 2024 17 2025 through June 30, 2025 2026. 18 19 SECTION 23. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 20 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS 21 CHILDREN'S HOSPITAL AND TRANSFER AUTHORIZED. Thirty -three and one-third 22 percent (33-1/3%), in each fiscal year, of the amounts made available to fund 23 the appropriation in the Grants to Children's Hospital, Regular Salaries and 24 Operating Expenses for Indigent Care line item of the Operations 25 appropriation section of this Act shall be distributed to the Arkansas 26 Children's Hospital or Arkansas Children's Hospital may request that the 27 University of Arkansas for Medical Sciences transfer such funds each fiscal 28 year from the University of Arkansas Medical Center Fund to the Department of 29 Human Services Grants Fund Account. The transferred funds shall be used to 30 match federal funds used for supplemental Medicaid payments to Arkansas 31 Children's Hospital. 32 The provisions of this section shall be in effect only from July 1, 2024 33 2025 through June 30, 2025 2026. 34 35 SECTION 24. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 36 As Engrossed: S3/17/25 SB128 20 03-17-2025 16:22:29 HAR039 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 1 FORWARD. Any unexpended balance of the general revenue funds provided by this 2 Act which remains at the close of a fiscal year, not to exceed ten percent 3 (10%) of funded appropriations, shall be carried forward and made available 4 for the same purposes for the next fiscal year. 5 Any carry forward of unexpended balance of funding as authorized herein, 6 may be carried forward under the following conditions: 7 (1) Prior to June 30, 2025 2026 the Agency shall by written statement set 8 forth its reason(s) for the need to carry forward said funding to the 9 Department of Finance and Administration Office of Budget; 10 (2) The Department of Finance and Administration Office of Budget shall 11 report to the Arkansas Legislative Council all amounts carried forward by the 12 September Arkansas Legislative Council or Joint Budget Committee meeting 13 which report shall include the name of the Agency, Board, Commission or 14 Institution and the amount of the funding carried forward, the program name 15 or line item, the funding source and a copy of the written request set forth 16 in (1) above; 17 (3) Each Agency, Board, Commission or Institution shall provide a written 18 report to the Arkansas Legislative Council or Joint Budget Committee 19 containing all information set forth in item (2) above, along with a written 20 statement as to the current status of the project, contract, purpose, etc. 21 for which the carry forward was originally requested no later than thirty 22 (30) days prior to the time the Agency, Board, Commission or Institution 23 presents its budget request to the Arkansas Legislative Council/Joint Budget 24 Committee; and 25 (4) Thereupon, the Department of Finance and Administration shall include 26 all information obtained in item (3) above in the budget manuals and/or a 27 statement of non-compliance by the Agency, Board, Commission or Institution. 28 The provisions of this section shall be in effect only from July 1, 2024 29 2025 through June 30, 2025 2026. 30 31 SECTION 25. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 33 ESTABLISHMENT OF A "GROWTH POOL". (a) The Arkansas Division of Higher 34 Education shall establish and maintain for the 2024-2025 2025-2026 fiscal 35 year a pool of three six hundred (300 600) non-classified positions . A 36 As Engrossed: S3/17/25 SB128 21 03-17-2025 16:22:29 HAR039 position established under this section shall not exceed the salary rate of 1 the highest maximum annual salary rate authorized by the General Assembly in 2 the institution's appropriation act. These positions are to be used by the 3 University of Arkansas for Medical Sciences in the event that the personal 4 services needs of the University during the 2024-2025 2025-2026 fiscal year 5 exceed the number of positions allocated to the University by the 6 Legislature. The University shall provide justification to the Arkansas 7 Division of Higher Education for the need to allocate titles from this 8 "growth pool". No classifications titles will be assigned to the pool until 9 such time as specific positions are requested by the University, approved by 10 the University Board or their designee, and approved by the Legislative 11 Council or Joint Budget Committee. Furthermore, the Arkansas Division of 12 Higher Education shall establish and maintain for the 2024-2025 fiscal year a 13 pool of three hundred (300) career service positions up to a C130. These 14 positions are to be used by the University of Arkansas for Medical Sciences 15 in the event that the personal services needs of the University during the 16 2024-2025 fiscal year exceed the number of positions in a classification 17 allocated to the University by the Legislature. The University shall provide 18 justification to the Arkansas Division of Higher Education for the need to 19 allocate titles from this "growth pool". No classifications will be assigned 20 to the pool until such time as specific positions are requested by the 21 University, recommended by the Arkansas Division of Higher Education, and 22 approved by the Legislative Council or Joint Budget Committee. 23 (b) Determining the number of personnel to be employed by a state agency 24 is the prerogative of the General Assembly and is usually accomplished by 25 delineating the maximum number of personnel by identifying the job titles and 26 the maximum grade or salary attached to those salaries. The General Assembly 27 has determined that the University of Arkansas for Medical Sciences could be 28 operated more efficiently if some flexibility is given to that institution. 29 That flexibility is being accomplished by providing growth pools in 30 subsection (a) of this section and since the General Assembly has granted the 31 institution broad powers under the growth pool concept, it is both necessary 32 and appropriate that the General Assembly maintain oversight of the 33 utilization of the growth pool by requiring prior approval of the Legislative 34 Council or Joint Budget Committee in the utilization of the growth pool. 35 Therefore, the requirement of approval by the Legislative Council or Joint 36 As Engrossed: S3/17/25 SB128 22 03-17-2025 16:22:29 HAR039 Budget Committee is not a severable part of this section. If the requirement 1 of approval by the Legislative Council or Joint Budget Committee is ruled 2 unconstitutional by a court of competent jurisdiction, this entire section is 3 void. 4 If the agency requests continuation of a "Growth Pool" position(s) as 5 established herein during the next fiscal year, the position(s) must be 6 requested as a new position(s) in the agency's budget request. 7 The provisions of this section shall be in effect only from July 1, 2024 8 2025 through June 30, 2025 2026. 9 10 SECTION 26. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CHILD 12 HEALTH AND FAMILY LIFE INSTITUTE. The Child Health and Family Life Institute 13 shall be administered under the direction of Arkansas Children’s Hospital. 14 Arkansas Children’s Hospital shall enter into a cooperative agreement and/or 15 contract with the University of Arkansas for Medical Sciences -Department of 16 Pediatrics for services required to deliver the programs of the Child Health 17 and Family Life Institute (CHFLI). Utilizing a multidisciplinary 18 collaboration of professionals, CHFLI shall provide a statewide effort to 19 explore, develop and evaluate new and better ways to address medically, 20 socially and economically interrelated health and developmental needs of 21 children with special health care needs and their families. CHFLI priorities 22 shall include, but are not limited to, wellness and prevention, screening and 23 diagnosis, treatment and intervention, training and education and research 24 and evaluation. Arkansas Children’s Hospital and the University of Arkansas 25 for Medical Sciences -Department of Pediatrics shall make annual reports to 26 the Arkansas Legislative Council on all matters of funding, existing programs 27 and services offered through CHFLI. 28 The provisions of this section shall be in effect only from July 1, 2024 29 2025 through June 30, 2025 2026. 30 31 SECTION 27. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PARKING 33 FEES. On July 1 of each year the University of Arkansas for Medical Sciences 34 shall pay from the appropriation provided herein from non -general revenue, 35 the total amount appropriated for War Memorial Parking Services from Fees to 36 As Engrossed: S3/17/25 SB128 23 03-17-2025 16:22:29 HAR039 War Memorial. 1 The provisions of this section shall be in effect only from July 1, 2024 2 2025 through June 30, 2025 2026. 3 4 SECTION 28. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 5 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 6 PROVISIONS. Because the Rural Medical Practice Student Loan and Scholarship 7 Program Loans and/or Scholarships and the Community Match Student Loan and 8 Scholarship Program Loans and/or Scholarships have the goal of providing 9 primary care physicians in rural Arkansas, transfers may be made in such 10 amounts as are required between the line items made in the appropriation for 11 "Medical Loans and Scholarships". 12 The provisions of this section shall be in effect only from July 1, 2024 13 2025 through June 30, 2025 2026. 14 15 SECTION 29. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 16 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CLINICAL 17 EXPANSION AND RESEARCH POOL. (a) In order to address personnel needs emerging 18 from expanding medical research and patient care issues and the necessity of 19 recruiting and retaining qualified medical, research, and related support 20 personnel, the University of Arkansas for Medical Sciences or its successor 21 is authorized for the 2024-2025 2025-2026 fiscal year a pool of seven hundred 22 (700) "Clinical Expansion and Research Pool" positions. These positions are 23 to be used by the University of Arkansas for Medical Sciences in the event 24 that the personal services needs resulting from unanticipated clinical or 25 research programs that are initiated during the 2024-2025 2025-2026 fiscal 26 year require additional positions, either in title, in classification, or in 27 number, that are not authorized or contemplated by the General Assembly in 28 the Regular Salaries - Operations section of this Act. 29 (b) The University of Arkansas for Medical Sciences is authorized to 30 access the "Clinical Expansion and Research Pool" positions authorized in 31 this Section at any time during the fiscal year when it is determined by the 32 Chancellor of the University of Arkansas for Medical Sciences, subject to the 33 review and approval by the Board of Trustees, that the need for additional 34 positions exists. Only medical or research positions shall be established 35 under this provision. The Chancellor of the University of Arkansas for 36 As Engrossed: S3/17/25 SB128 24 03-17-2025 16:22:29 HAR039 Medical Sciences shall provide a quarterly report detailing the justification 1 of allocation of positions from this "Clinical Expansion and Research Pool" 2 to the Chief Fiscal Officer of the State, to the Arkansas Division of Higher 3 Education, and to the Arkansas Legislative Council or Joint Budget Committee 4 for review. The report shall also include an accounting of the names, titles 5 and salaries of personnel who have been employed in positions established 6 from this pool and the source and duration of funds associated with the 7 positions. 8 (c) If the University of Arkansas for Medical Sciences requests 9 continuation of any "Clinical Expansion and Research Pool" position(s) as 10 established herein during the next fiscal year, the position(s) must be 11 requested as a new position(s) in the agency's budget request. 12 (d) Determining the number of personnel to be employed by a state agency 13 is the prerogative of the General Assembly and is usually accomplished by 14 delineating the maximum number of personnel by identifying job titles and the 15 maximum grade or salary attached to those titles. The General Assembly has 16 determined that the University of Arkansas for Medical Sciences could be 17 operated more efficiently if some flexibility is given to that institution. 18 That flexibility is being accomplished by providing a position pool in 19 Subsection (a) of this Section and since the General Assembly has granted the 20 agency broad powers under the growth pool concept, it is both necessary and 21 appropriate that the General Assembly maintain oversight of the utilization 22 of the position pool by requiring review of the Legislative Council or Joint 23 Budget Committee in the utilization of the position pool. Therefore, the 24 requirement of review by the Legislative Council or Joint Budget Committee is 25 not a severable part of this section. If the requirement of review by the 26 Legislative Council or Joint Budget Committee is ruled unconstitutional by a 27 court of competent jurisdiction, this entire section is void. 28 The provisions of this section shall be in effect only from July 1, 2024 29 2025 through June 30, 2025 2026. 30 31 SECTION 30. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ABUSED 33 CHILDREN AND ADOLESCENTS SERVICES PROGRAM FUNDING PROVISION. In the event 34 the amount of general revenue distributed to the University of Arkansas 35 Medical Center Fund for the Department of Pediatrics and the Psychiatric 36 As Engrossed: S3/17/25 SB128 25 03-17-2025 16:22:29 HAR039 Research Institute each fiscal year is at least equal to the amount 1 distributed during the 2012 -13 fiscal year, an amount not less than seven 2 hundred thousand dollars ($700,000) shall be allocated and made available as 3 follows: four hundred fifty thousand dollars ($450,000) each fiscal year 4 shall be made available exclusively to support the purposes and goals to 5 improve screening, monitoring and care for abused children and adolescents 6 through the Child Safety Centers or the University of Arkansas for Medical 7 Sciences as referred by the Child Safety Centers. Maintenance of statewide 8 screening and assessment protocols as well as evidence -based training of 9 mental health professionals are to be considered critical components of the 10 overall goals. For the provision of assessment and therapeutic services, 11 these funds are to be provided to the Child Safety Centers through contracts 12 from the University of Arkansas for Medical Sciences. The contracts will 13 stipulate the terms of the agreement and reporting requirements; an amount 14 not to exceed fifty thousand dollars ($50,000) may be utilized for 15 administrative costs as may be necessary to administer the program or if 16 determined not to be needed for administrative costs may be placed in reserve 17 for future needs of the program. The remaining two hundred thousand dollars 18 ($200,000) shall be allocated and made available to the Department of 19 Pediatrics for expenses for medical examinations, consultation, education and 20 training as stipulated in the terms of agreement between the Chancellor of 21 the University of Arkansas for Medical Sciences and the Department of 22 Pediatrics. 23 The provisions of this section shall be in effect only from July 1, 2024 24 2025 through June 30, 2025 2026. 25 26 SECTION 31. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 27 authorized by this act shall be limited to the appropriation for such agency 28 and funds made available by law for the support of such appropriations; and 29 the restrictions of the State Procurement Law, the General Accounting and 30 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 31 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 32 Act, or their successors, and other fiscal control laws of this State, where 33 applicable, and regulations promulgated by the Department of Finance and 34 Administration, as authorized by law, shall be strictly complied with in 35 disbursement of said funds. 36 As Engrossed: S3/17/25 SB128 26 03-17-2025 16:22:29 HAR039 1 SECTION 32. LEGISLATIVE INTENT. It is the intent of the General 2 Assembly that any funds disbursed under the authority of the appropriations 3 contained in this act shall be in compliance with the stated reasons for 4 which this act was adopted, as evidenced by the Agency Requests, Executive 5 Recommendations and Legislative Recommendations contained in the budget 6 manuals prepared by the Department of Finance and Administration, letters, or 7 summarized oral testimony in the official minutes of the Arkansas Legislative 8 Council or Joint Budget Committee which relate to its passage and adoption. 9 10 SECTION 33. EMERGENCY CLAUSE. It is found and determined by the 11 General Assembly, that the Constitution of the State of Arkansas prohibits 12 the appropriation of funds for more than a one (1) year period; that the 13 effectiveness of this Act on July 1, 2025 is essential to the operation of 14 the agency for which the appropriations in this Act are provided, and that in 15 the event of an extension of the legislative session, the delay in the 16 effective date of this Act beyond July 1, 2025 could work irreparable harm 17 upon the proper administration and provision of essential governmental 18 programs.
