BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17

SECTION 1. Arkansas Code Title 2, Chapter 19, Subchapter 5, is 19
repealed. 20
2-19-501. Definition. 21
“One hundred percent (100%) natural organic fertilizer” shall be 22
defined as and include the following: 23
(1)(A) One hundred percent (100%) organic fertilizer — Materials 24
derived from either plant or animal products containing one (1) or more 25
elements other than carbon, hydrogen, and oxygen which are essential for 26
plant growth. 27
(B) These materials may be subjected to biological 28
degradation processes under conditions of drying, composting, enzymatic or 29
anaerobic/aerobic bacterial action or any combination of these. 30
(C) These materials shall not be mixed with synthetic 31
materials; 32
(2) One hundred percent (100%) natural organic fertilizer shall 33
be processed from only one hundred percent (100%) animal substrate. No other 34
organic or inorganic, natural or synthetic, additives shall be used during 35
processing and no fortification may be used; 36 SB224

(3) One hundred percent (100%) natural organic fertilizers shall 1
contain as a guaranteed analysis not less than: nitrogen (N), four percent 2
(4.0%); phosphoric acid (P2O5), two percent (2.0%); and potash (K2O), four 3
percent (4.0%); and 4
(4) Determination of the guaranteed analysis will be according 5
to methods adopted by the AOAC International. (Fertilizers and Materials 6
Containing Large Quantities of Organic Matter; 12th edition, With Following 7
Improvements.). 8

2-19-502. Regulation and supervision — Fees and penalties — Guarantee 10
of elements. 11
(a) The State Plant Board shall have the authority to regulate and 12
supervise the manufacture and sale of one hundred percent (100%) natural 13
organic fertilizer, including the setting and collecting of reasonable fees 14
for sampling and analyzing the fertilizer and registering manufacturers, and 15
shall adopt and promulgate such rules and penalties consistent with this 16
subchapter, and § 2-19-202, as may be necessary. 17
(b) The fees and penalties set and collected by the board under this 18
section shall not exceed like fees and penalties set for other types of 19
fertilizers. 20
(c) When any reference or claim is made on the label for secondary or 21
minor plant nutrients, a specific guarantee of the specific elements 22
contained shall be given in the guaranteed analysis. 23

2-19-503. Exemptions. 25
This subchapter shall not affect the private sale of unprocessed animal 26
litter, nor shall the State Plant Board regulate the private sale of 27
unprocessed animal litter which is not sold as one hundred percent (100%) 28
natural organic fertilizer as defined by this subchapter. 29
