BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

SECTION 1. Arkansas Code ยง 6 -17-414(g)(5), concerning a waiver of the 24
required background check for a nonlicensed staff position granted by the 25
adoption of a resolution by the board of trustees of an educational entity, 26
is amended to add an additional subdivision to read as follows: 27
(D) A waiver granted by a board of directors of an 28
educational entity under this subdivision (g)(5) shall be valid for the 29
duration of the applicant's employment with the educational entity only if 30
the applicant does not experience: 31
(i) A break in employment with the educational 32
entity after receiving the waiver; and 33
(ii) An additional disqualifying conviction under 34
this section after receiving the waiver. 35
