Penzo 5 By: Representative Pilkington 6 7 For An Act To Be Entitled 8 AN ACT TO REQUIRE CERTAIN TESTING OF PROCESSED 9 MARIJUANA PRODUCTS SOLD AS MEDICAL MARIJUANA; AND FOR 10 OTHER PURPOSES. 11 12 13 Subtitle 14 TO REQUIRE CERTAIN TESTING OF PROCESSED 15 MARIJUANA PRODUCTS SOLD AS MEDICAL 16 MARIJUANA. 17 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19 20 SECTION 1. Arkansas Code Title 20, Chapter 56, Subchapter 3, is 21 amended to add an additional section to read as follows: 22 20-56-309. Testing of processed marijuana product — Definition. 23 (a)(1) As used in this section, "processed marijuana product" means a 24 marijuana product intended for human consumption that has been altered from 25 the usable marijuana under the Arkansas Medical Marijuana Amendment of 2016, 26 Arkansas Constitution, Amendment 98, by extraction, concentration, 27 encapsulation, chemical manipulation, or other process. 28 (2) "Processed marijuana product" includes without limitation 29 edibles, oils, concentrations, tinctures, topicals, inhalables, and other 30 forms of marijuana that have been infused or processed. 31 (3)(A) "Processed marijuana product" is separate and distinct 32 from marijuana paraphernalia that requires the combustion of marijuana to be 33 properly utilized, including pipes, water pipes, bongs, chillums, rolling 34 papers, and roach clips. 35 (B) "Processed marijuana product" is not subject to 36 SB305 2 02/25/2025 2:16:19 PM JMB290 prohibitions that are applicable to paraphernalia. 1 (b) All processed marijuana products shall be tested after being fully 2 processed and in the form of a finished product suitable for packaging. 3 (c) The testing under this section shall comply with the rules of the 4 Department of Health and include without limitation the testing of: 5 (1) Pesticides; 6 (2) Heavy metals; 7 (3) Microbiological contaminants; 8 (4) Residual solvents; and 9 (5) Concentrations of tetrahydrocannabinol and cannabidiol. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
