BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

SECTION 1. Arkansas Code ยง 5 -70-103(b), concerning the penalties 22
associated with sexual solicitation, is amended to read as follows: 23
(b) Sexual solicitation is an unclassified misdemeanor with the 24
following sentences: 25
(1) For a first offense :, a Class A misdemeanor 26
(A) No more than ninety (90) days' imprisonment; 27
(B) A fine of no more than two thousand dollars ($2,000); 28
or 29
(C) Both imprisonment and a fine ; and 30
(2) For a second or subsequent offense , a Class D felony: 31
(A) No more than one (1) year of imprisonment; 32
(B) A fine of no more than three thousand five hundred 33
dollars ($3,500); or 34
(C) Both imprisonment and a fine . 35
