Bryant 5 By: Representative Unger 6 7 For An Act To Be Entitled 8 AN ACT TO AMEND THE UNIFORM ATTENDANCE AND LEAVE 9 POLICY ACT; TO APPLY MILITARY SERVICE CREDIT TO A 10 PUBLIC EMPLOYEE'S TOTAL SERVICE TIME FOR ANNUAL LEAVE 11 ACCRUAL CALCULATION; AND FOR OTHER PURPOSES. 12 13 14 Subtitle 15 TO AMEND THE UNIFORM ATTENDANCE AND 16 LEAVE POLICY ACT; AND TO APPLY MILITARY 17 SERVICE CREDIT TO A PUBLIC EMPLOYEE'S 18 TOTAL SERVICE TIME FOR ANNUAL LEAVE 19 ACCRUAL CALCULATION. 20 21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22 23 SECTION 1. Arkansas Code ยง 21 -4-204, concerning the accrual of leave 24 under the Uniform Attendance and Leave Policy Act, is amended to add an 25 additional subsection to read as follows: 26 (h)(1)(A) An employee under subdivisions (a)(1) and (2) of this 27 section shall receive military service credit for prior military service that 28 otherwise would not be creditable for the purpose of determining his or her 29 annual leave accrual rate. 30 (B) Subdivision (h)(1)(A) of this section applies 31 only if the employee: 32 (i) Retired from military service; 33 (ii) Was honorably discharged from military 34 service; 35 (iii) Currently serves in the Arkansas 36 SB357 2 03/03/2025 12:50:35 PM LGL125 National Guard and served in the Arkansas National Guard before employment 1 with the State of Arkansas; 2 (iv) Served in the Arkansas National Guard 3 before employment with the State of Arkansas; 4 (iv) Currently serves in a military reserve 5 unit and served in a military reserve unit before employment with the State 6 of Arkansas; or 7 (v) Served in a military reserve unit before 8 employment with the State of Arkansas. 9 (2)(A) An agency head, or his or her designee, shall provide 10 military service credit for the purpose of determining the annual leave 11 accrual rate under subdivisions (a)(1) and (2) of this section to an employee 12 described in subdivision (h)(1)(B) of this section upon written documentation 13 of the employee's military service. 14 (B) A retired or honorably discharged member of the 15 military shall provide an agency head, or his or her designee, a copy of his 16 or her discharge information. 17 (C)(i) A former or current member of the Arkansas National 18 Guard or a military reserve unit shall provide proof of service by providing 19 documentation reflecting his or her years of military service before 20 employment with the State of Arkansas, including without limitation: 21 (a) An NGB Form 23A; 22 (b) A DA Form 5016; 23 (c) A Career Retirement Credit Report; 24 (d) An Annual Statement of Service History; 25 (e) An Air National Guard/United States Air 26 Force Reserve Point Credit Summary Inquiry; or 27 (f) A reserve Point Statement. 28 (ii)(a) Military service credit under subdivision 29 (h)(1)(A) of this section for service in the Arkansas National Guard or a 30 military reserve unit shall be calculated as the total career points, or the 31 equivalent, on the documentation required under subdivision (h)(2)(C)(i) of 32 this section for each year the member was not an employee of the State of 33 Arkansas divided by three hundred sixty -five (365). 34 (b) As used in subdivision (h)(2)(C)(ii)(a) of 35 this section, "total career points, or the equivalent" means: 36 SB357 3 03/03/2025 12:50:35 PM LGL125 (1) "Total career points" on an NGB Form 1 23A; 2 (2) "Total points creditable" on a DA 3 Form 5016; 4 (3) "Total points creditable" on a 5 Career Retirement Credit Report; 6 (4) "Total points" on an Annual 7 Statement of Service History; 8 (5) "Total points for retirement" on an 9 Air National Guard/United States Air Force Reserve Point Credit Summary 10 Inquiry; and 11 (6) "Reserve retirement points" on a 12 Reserve Point Statement. 13 (3)(A) An employee under subdivisions (a)(1) and (2) of this 14 section shall not receive military service credit under subdivision (h)(1)(A) 15 of this section for active -duty service accrued while concurrently a member 16 of the military service and an employee of the State of Arkansas. 17 (B) A current member of the Arkansas National Guard or a 18 military reserve unit shall not receive military service credit under 19 subdivision (h)(1)(A) of this section for any career points that he or she 20 accrued during a year when the member was a state employee for any part of 21 that year. 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
