Act 778 of the Regular Session *JMB239* 04-07-2025 15:52:42 JMB239 State of Arkansas As Engrossed: S4/7/25 1 95th General Assembly A Bill 2 Regular Session, 2025 SENATE BILL 369 3 4 By: Senator Irvin 5 By: Representative Wing 6 7 For An Act To Be Entitled 8 AN ACT TO REPEAL THE COMPUTER AND ELECTRONIC 9 EQUIPMENT RECYCLING GRANTS; TO REPEAL THE COMPUTER 10 AND ELECTRONIC RECYCLING FUND; TO MODIFY THE 11 DISBURSEMENT OF REVENUES GENERATED FROM THE SALE OF 12 AGENCY SURPLUS COMPUTER AND ELECTRONIC EQUIPMENT; AND 13 FOR OTHER PURPOSES. 14 15 16 Subtitle 17 TO REPEAL THE COMPUTER AND ELECTRONIC 18 EQUIPMENT RECYCLING GRANTS; AND TO 19 REPEAL THE COMPUTER AND ELECTRONIC 20 RECYCLING FUND. 21 22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23 24 SECTION 1. Arkansas Code § 19-5-1217 is repealed. 25 19-5-1217. Computer and Electronic Recycling Fund. 26 (a) There is established on the books of the Treasurer of State, the 27 Auditor of State, and the Chief Fiscal Officer of the State a fund to be 28 known as the “Computer and Electronic Recycling Fund”. 29 (b) The fund shall be administered by the Division of Environmental 30 Quality and may be used to: 31 (1) Promote market research and development grants to determine 32 the most efficient means of collecting, transporting, and processing scrap 33 electronic equipment; 34 (2) Work with the Department of Finance and Administration and 35 the Marketing and Redistribution Section to establish statewide contracts for 36 As Engrossed: S4/7/25 SB369 2 04-07-2025 15:52:42 JMB239 computer and electronics recycling and demanufacturing businesses; and 1 (3) Support and fund other measures necessary to implement and 2 promote the recycling, donation, demanufacturing, or disposal options for 3 computers and electronic equipment. 4 5 SECTION 2. Arkansas Code § 25 -34-108 is amended to read as follows: 6 25-34-108. Disbursement of revenues. 7 Funds generated from the sale of agency surplus computer and electronic 8 equipment to state employees, public schools, or by other sale shall be 9 allocated as follows: 10 (1) If the sale of surplus computer or electronic equipment is 11 made within the agency: 12 (A) Sixty percent (60%) of the proceeds shall be returned 13 to the owning agency; and 14 (B) Fifteen percent (15%) Forty percent (40%) of the 15 proceeds shall be deposited with the Marketing and Redistribution Section; 16 and 17 (C) Twenty-five percent (25%) of the proceeds shall be 18 deposited into the Computer and Electronic Recycling Fund established by this 19 chapter; and 20 (2) If the sale of surplus computer or electronic equipment is 21 outside the agency and conducted by the Marketing and Redistribution Section: 22 (A) Fifty percent (50%) of the proceeds shall be returned 23 to the owning agency; and 24 (B) Twenty-five percent (25%) Fifty percent (50%) of the 25 proceeds shall be deposited with the Marketing and Redistribution Section ; 26 and 27 (C) Twenty-five percent (25%) of the proceeds shall be 28 deposited into the fund established by this chapter and § 19 -5-1217. 29 30 SECTION 3. Arkansas Code §§ 25 -34-109 and 25-34-110 are repealed. 31 25-34-109. Computer and electronic equipment recycling grants. 12 (a) Electronic equipment recycling grants must be awarded on the basis 13 of written grant-request proposals submitted to and approved by the Division 14 of Environmental Quality. 15 (b) Grant requests shall be considered based upon the following 16 criteria: 17 (1) The development of sustained processes for recovery, 18 recycling, and demanufacturing of scrap computers and electronics; 19 (2) Minimization and elimination of substantial volumes of this 20 material as waste; 21 (3) Creation of Arkansas jobs; 22 (4) Return of investment analysis; and 23 (5) Available funds. 24 25 /s/Irvin 26 27 28 APPROVED: 4/17/25 29 30 31 32 33 34 35 36
