AN ACT TO AMEND THE LAW CONCERNING THE SIGNAL LEGEND 9
OF TRAFFIC CONTROL DEVICES; TO ALLOW A VEHICLE DRIVER 10
TO ENTER AN INTERSECTION WHILE A RED LIGHT IS 11
INDICATED ON A TRAFFIC CONTROL DEVICE IN CERTAIN 12
CIRCUMSTANCES; AND FOR OTHER PURPOSES. 13

TO AMEND THE LAW CONCERNING THE SIGNAL 17
LEGEND OF TRAFFIC CONTROL DEVICES; AND 18
TO ALLOW A VEHICLE DRIVER TO ENTER AN 19
INTERSECTION WHILE A RED LIGHT IS 20
INDICATED ON A TRAFFIC CONTROL DEVICE IN 21
CERTAIN CIRCUMSTANCES. 22

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

SECTION 1. Arkansas Code ยง 27 -52-107(a)(3)(A), concerning exceptions 26
to when vehicular traffic facing a steady red traffic control light or a 27
traffic control signal exhibiting the word "STOP" shall stop and remain 28
standing, is amended to add an additional subdivision to read as follows: 29
(iii)(a) Vehicular traffic facing the signal may 30
cautiously enter the intersection if: 31
(1) There is no other vehicular traffic 32
approaching or in the intersection; and 33
(2) Before entering the intersection, 34
the operator of the vehicle comes to a complete stop on the near side of the 35
intersection before entering a crosswalk, clearly marked stop line, or point 36 SB372

nearest the intersecting roadway where the operator has a view of approaching 1
traffic on the intersecting roadway. 2
(b) If other vehicular traffic has entered the 3
intersection from another roadway or is approaching the intersection, the 4
operator of the vehicle shall not enter the intersection. 5
(c) If the operator of a vehicle enters an 6
intersection under this subdivision (a)(3)(A)(iii), all other vehicular 7
traffic approaching or entering the intersection after the operator of the 8
vehicle enters the intersection shall yield to the operator of the vehicle 9
entering the intersection; and 10
