AN ACT CONCERNING THE ADMINISTRATION OF A STATEWIDE 9 
STUDENT ASSESSMENT TO A STUDENT IN A VIRTUAL SETTING; 10 
TO REQUIRE AN ADULT APPROVED TO OVERSEE THE 11 
ADMINISTRATION OF A STATEWIDE STUDENT ASSESSMENT TO 12 
CERTAIN STUDENTS IN A VIRTUAL SETTING TO MEET CERTAIN 13 
REQUIREMENTS; AND FOR OTHER PURPOSES. 14

THE ADMINISTRATION OF A STATEWIDE 19 
STUDENT ASSESSMENT TO CERTAIN STUDENTS 20 
IN A VIRTUAL SETTING TO MEET CERTAIN 21 
REQUIREMENTS. 22

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

 SECTION 1.  Arkansas Code ยง 6 -18-114(b)(5), concerning requirements a 26 
public school that operates primarily as a virtual school and that 27 
administers a statewide student assessment to a student in a virtual setting 28 
must meet, is amended to read as follows: 29 
 (5)(A) An adult approved in accordance with terms established by 30 
the public school that primarily operates as a virtual school and is 31 
administering a statewide student assessment to a student in kindergarten 32 
through grade eight (K -8) in a virtual setting, including without limitation 33 
the student's parent, legal guardian, or person standing in loco parentis to 34 
the student, is physically present with the student for the duration of the 35 
administration of the statewide student assessment . 36    	SB470

 (B)  An adult approved in accordance with terms established 1 
by the public school that primarily operates as a virtual school and 2 
administering a statewide student assessment to a student in grades nine 3 
through twelve (9-12) in a virtual setting, including without limitation the 4 
student's parent, legal guardian, or person standing in loco parentis to the 5 
student, shall attest prior to the administration of an assessment to the 6 
student in a virtual setting that the student and the approved adult shall 7 
adhere to all current testing security protocols ; 8
