Clark 5 By: Representative Ray 6 7 For An Act To Be Entitled 8 AN AMENDMENT TO ARKANSAS CONSTITUTION, ARTICLE 5, 9 SECTION 1, TO REQUIRE THAT THE BALLOT TITLE OF A 10 PROPOSED MEASURE BE READABLE, CLEAR, AND CONCISE AND 11 NOT EXCEED FIVE HUNDRED WORDS; TO AMEND THE ARKANSAS 12 CONSTITUTION UNDER THE AUTHORITY OF ARKANSAS 13 CONSTITUTION, ARTICLE 5, SECTION 1; AND FOR OTHER 14 PURPOSES. 15 16 17 Subtitle 18 AN AMENDMENT TO THE ARKANSAS 19 CONSTITUTION CONCERNING BALLOT TITLES OF 20 PROPOSED MEASURES; AND AMENDING THE 21 ARKANSAS CONSTITUTION UNDER THE 22 AUTHORITY OF ARKANSAS CONSTITUTION, 23 ARTICLE 5, SECTION 1. 24 25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 26 27 SECTION 1. DO NOT CODIFY. LEGISLATIVE INTENT. 28 (a) The General Assembly finds: 29 (1) Arkansas Constitution, Article 5, § 1, provides that "[n]o 30 measure approved by a vote of the people shall be amended or repealed by the 31 General Assembly. . . except upon a yea and nay vote on roll call of two -32 thirds of all the members elected to each house of the General Assembly. . 33 ."; 34 (2) Arkansas Constitution, Article 5, § 1, defines "measure" to 35 include any bill, law, resolution, ordinance, charter, constitutional 36 SB569 2 03/27/2025 9:51:15 AM MBM188 amendment or legislative proposal or enactment of any character; 1 (3) The plain language of the definition of "measure" in 2 Arkansas Constitution, Article 5, § 1, clearly includes amendments to the 3 Arkansas Constitution, meaning that the General Assembly may amend amendments 4 to the Arkansas Constitution with a two -thirds vote of each house; 5 (4) Despite observing that the definition of "measure" in 6 Arkansas Constitution, Article 5, § 1 includes "constitutional amendment(s) 7 'or legislative proposals of any character'", the Supreme Court in Arkansas 8 Game and Fish Commission v. Edgmon, 218 Ark. 207, 235 S.W.2d 554 (1951), 9 declined to construe the language literally and held that the General 10 Assembly lacked the power to amend or repeal amendments to the Arkansas 11 Constitution by a two -thirds vote of each house; 12 (5) In Board of Trustees of the University of Arkansas v. 13 Andrews, 2018 Ark. 12 (2018), the Supreme Court overturned years of precedent 14 by holding that the General Assembly cannot waive by law the state's 15 sovereign immunity granted by Arkansas Constitution, Article 5, § 20; 16 (6) In reaching its decision in Andrews, supra, the Supreme 17 Court held that the language of Arkansas Constitution, Article 5, § 20, 18 should be interpreted "precisely as it reads"; 19 (7) In Buonauito v. Gibson, 2020 Ark. 352, the Supreme Court 20 noted that the phrase "four -lane highway" as used in Arkansas Constitution, 21 Amendment 91, had been "given a specific meaning that is plain and 22 unambiguous" and thus funds under Arkansas Constitution, Amendment 91, could 23 not be used to improve six -lane portions of interstate highways; and 24 (8) An interpretation of Arkansas Constitution, Article 5, § 1, 25 "precisely as it reads" clearly leads to the conclusion that the General 26 Assembly may amend all measures, including constitutional amendments, by a 27 two-thirds vote of each house, as the term "measure" has been given a plain 28 and unambiguous definition in Arkansas Constitution, Article 5, § 1. 29 (b) By the passage of this act, the General Assembly expresses its 30 belief that, upon consideration of this act using the standard of review 31 established in Andrews, supra, the Supreme Court will: 32 (1) Interpret Arkansas Constitution, Article 5, § 1, precisely 33 as it reads in consideration of its plain and unambiguous language; 34 (2) Overturn its decision in Edgmon, supra, as inconsistent with 35 its holding in Andrews, supra, and Buonauito, supra; and 36 SB569 3 03/27/2025 9:51:15 AM MBM188 (3) Uphold the constitutional authority of the General Assembly 1 under Arkansas Constitution, Article 5, § 1, to amend or repeal amendments to 2 the Arkansas Constitution by a two -thirds vote of each house. 3 4 SECTION 2. Pursuant to the authority under Arkansas Constitution, 5 Article 5, § 1, the subsection of Arkansas Constitution, Article 5, § 1, 6 titled "Title" is amended to read as follows: 7 Title. At the time of filing petitions the exact title to be used on 8 the ballot shall by the petitioners be submitted with the petition, and on 9 state-wide measures, shall be submitted to the State Board of Election 10 Commissioners, who shall certify such title to the Secretary of State, to be 11 placed upon the ballot; on county and municipal measures such title shall be 12 submitted to the county election board and shall by said board be placed upon 13 the ballot in such county or municipal election.
