AUTHORITY DIVISION - TRANSFER OF FUNDS.  Building Authority Division is 3 
hereby authorized, after seeking the approval of the Chief Fiscal Officer of 4 
the State and the Arkansas Legislative Council or Joint Budget Committee to 5 
request transfer from the appropriation made in the Building Maintenance 6 
Section for Building Maintenance to the Acquisition and Maintenance 7 
appropriation in the Acquisition and Maintenance Section and to receive from 8 
another state agency that seeks like approvals its authority, appropriation 9 
and the transfer of funds to be deposited into the Building Authority 10 
Division Real Estate Fund to become part of the Acquisition and Maintenance 11 
appropriation, and to be used for any purposes as set forth by law for said 12 
Real Estate Fund. 13 
   Determining the maximum number of employees and the maximum amount of 14 
appropriation and general revenue funding for a state agency each fiscal year 15 
is the prerogative of the General Assembly.  This is usually accomplished by 16 
delineating such maximums in the appropriation act(s) for a state agency and 17 
the general revenue allocations authorized for each fund and fund account by 18 
amendment to the Revenue Stabilization law.  Further, the General Assembly 19 
has determined that Building Authority Division may operate more efficiently 20 
if some flexibility is provided to Building Authority Division authorizing 21 
broad powers under this section.  Therefore, it is both necessary and 22 
appropriate that the General Assembly maintain oversight by requiring prior 23 
approval of the Legislative Council or Joint Budget Committee as provided by 24 
this section.  The requirement of approval by the Legislative Council or 25 
Joint Budget Committee is not a severable part of this section.  If the 26 
requirement of approval by the Legislative Council or Joint Budget Committee 27 
is ruled unconstitutional by a court of competent jurisdiction, this entire 28 
section is void. 29 
   The provisions of this section shall be in effect only from July 1, 	2024 30 
2025 through June 30, 2025 2026. 31

 SECTION 35. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 7

AUTHORITY DIVISION - TRANSFER TO FACILITIES MANAGEMENT CONTINGENCY 9 
APPROPRIATION AUTHORITY. (a) In order to provide a more cost effective method 10 
to address the emerging infrastructure needs of Arkansas State Government, 11 
appropriations and funds transferred to the Facilities Management Contingency 12 
Appropriation are to be used in the event that the Building Authority 13 
Division executes one or more building contracts or maintenance agreements 14 
with State Agencies, and the appropriations or funds otherwise provided for 15 
the Building Authority Division are not sufficient to address those needs, 16 
and it is more cost effective for Building Authority Division to execute 17 
these services.  Any State Agency may transfer or deposit funds and 18 
appropriations to Building Authority Division - Facilities Management 19 
Contingency Appropriation authorized in the Building Maintenance Section of 20 
this Act to execute one or more building contracts or maintenance agreements 21 
with said State Agencies.  Building Authority Division shall provide 22 
justification to the Chief Fiscal Officer of the State for the need of such 23 
appropriations and funds transfers and seek and receive approval of the Chief 24 
Fiscal Officer of the State. Building Authority Division shall then seek and 25 
receive the approval of the Arkansas Legislative Council or Joint Budget 26 
Committee.  The requirement of approval by the Arkansas Legislative Council 27 
or Joint Budget Committee is not a severable part of the section.  If the 28 
requirement of approval by the Arkansas Legislative Council or Joint Budget 29 
Committee is ruled unconstitutional by a court of competent jurisdiction, 30 
this entire section is void. 31 
   (b) The Chief Fiscal Officer of the State shall make the necessary 32 
adjustments on his or her books and the books of the Auditor of the State for 33 
the transfer or deposit of the funds and appropriations from each State 34 
Agency to the appropriation authorized in the Building Maintenance Section of 35

exclusively by Building Authority Division for the fiscal year. 1

 SECTION 36. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 5

BUILDING AUTHORITY DIVISION - SUSTAINABLE BUILDING DESIGN PROGRAM - TRANSFER. 7 
In the event there is not sufficient appropriation and/or funding provided 8 
for by the General Assembly for any state agency, board or commission to 9 
participate in the Sustainable Building Design Program for renovations of 10 
state owned property which exceeds two hundred fifty thousand dollars 11 
($250,000), the agency may request a transfer from the Sustainable Building 12 
Design Program appropriation authorized in the Sustainable Building Design 13 
Program Section of this Act from the Chief Fiscal Officer of the State. The 14 
request shall clearly state the amount required and such other information as 15 
may be required by the Chief Fiscal Officer of the State necessary to make a 16 
decision regarding the request. Upon approval of the Chief Fiscal Officer of 17 
the State and prior review by the Arkansas Legislative Council or Joint 18 
Budget Committee, the State Auditor shall be notified as of the amount and 19 
the purposes for which the appropriation and/or funding is to be transferred 20 
and shall be established upon the books of the Department of Finance and 21 
Administration and the State Auditor.  If desired, the appropriation may be 22 
supplemental to those regularly appropriated for like purposes by the General 23 
Assembly for that agency. 24 
   Provided further, that all state agencies, boards or commissions shall 25 
have prior approval by the Building Authority Division as authorized for the 26 
Sustainable Building Design Program in accordance with established Rules and 27 
Regulations. 28 
   The provisions of this section shall be in effect only from July 1, 	2024 29 
2025 through June 30, 2025 2026. 30

 SECTION 37. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 32

BUILDING AUTHORITY DIVISION - SUSTAINABLE BUILDING DESIGN PROGRAM - REVOLVING 34 
LOAN FUND.  The Sustainable Building Design Program Appropriation is intended 35

Design Program.  Funding for the program may be made available by the Chief 1 
Fiscal Officer of the State, in the form of a loan, from a transfer from the 2 
Sustainable Building Design Revolving Loan Fund after the required review by 3 
the Arkansas Legislative Council or Joint Budget Committee, approval by the 4 
Chief Fiscal Officer of the State and approval through rules established and 5 
administered by Building Authority Division.  Moneys made available for the 6 
repayment of a loan shall be deposited to the credit of the Sustainable 7 
Building Design Revolving Loan Fund as a “Refund to Expenditure” for the year 8 
in which the deposit is made. In the event that the funds for the repayment 9 
of a loan are held in depositories other than the State Treasury, the 10 
administrative head of the affected state agency shall issue a check drawn 11 
against the funds, which shall be deposited in the Sustainable Building 12 
Design Revolving Loan Fund. 13 
   The provisions of this section shall be in effect only from July 1, 	2024 14 
2025 through June 30, 2025 2026. 15

 SECTION 38. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 17

AUTHORITY DIVISION - FUNDING TRANSFER - CASH FUND ACCOUNT.  Building 19 
Authority Division is authorized to transfer any unspent funds remaining in 20 
any cash fund account established for the management of a state owned 21 
facility managed by, but not owned by, Building Authority Division to the 22 
Building Authority Maintenance Fund to support the facility’s Maintenance and 23 
Operations appropriations. 24 
   The provisions of this section shall be in effect only from July 1, 	2024 25 
2025 through June 30, 2025 2026. 26

 SECTION 39. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 28

DIVISION OF INFORMATION SYSTEMS - COMPLIANCE WITH STATE AND FEDERAL 30 
REGULATIONS.   31 
1.  In order to effect compliance with the requirements of state and federal 32 
statutory and regulatory provisions, the Director shall adjust billing rates 33 
or issue billing adjustments to be federally compliant, notwithstanding the 34 
provisions of ACA §25 -4-105 and §25-4-119 or funds sufficient to effect 35

Revenues or such other fund sources as may become available.  These actions 1 
shall be subject to the approval of the Chief Fiscal Officer of the State and 2 
approval by the Arkansas Legislative Council or Joint Budget Committee.  3 
2.  The Director shall have authority to transfer funds between the 4 
Information Technology Reserve Fund established by ACA §25 -4-123 and the 5 
Division of Information Systems Revolving Fund established by ACA §25	-4-121 6 
for cash management purposes. 7

PROVISION - LINE ITEMS - DIVISION OF INFORMATION SYSTEMS - OPERATIONS.  After 29 
receiving approval from the Chief Fiscal Officer of the State and prior 30 
review by the Arkansas Legislative Council or Joint Budget Committee, the 31 
Secretary of the Department of Transformation and Shared Services is 32 
authorized to transfer appropriation between the line items authorized herein 33 
for the Division of Information Systems - Operations to best utilize 34 
resources to respond to the needs of the Division's customers. 35

 SECTION 41. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 3 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  ARKANSAS 4 
GEOGRAPHIC INFORMATION SYSTEMS OFFICE - TRANSFER OF CARRY FORWARD.  Any 5 
unexpended balance of funds remaining on June 30 of each fiscal year in the 6 
Miscellaneous Agencies Fund Account for the Arkansas Geographic Information 7 
Systems Office, shall be transferred to the Geographic Information Systems 8 
Fund to be used for operating and maintaining the Arkansas Spatial Data 9 
Infrastructure, creating, updating, maintaining and disseminating framework 10 
spatial data as defined by Arkansas Code §15 -21-502. 11 
(1)  Prior to June 30, 2025 2026 the Agency shall by written statement set 12 
forth its reason(s) for the need to carry forward said funding to the 13 
Department of Finance and Administration Office of Budget; 14 
(2)  The Department of Finance and Administration Office of Budget shall 15 
report to the Arkansas Legislative Council all amounts carried forward by the 16 
September Arkansas Legislative Council or Joint Budget Committee meeting 17 
which report shall include the name of the Agency, Board, Commission or 18 
Institution and the amount of the funding carried forward, the program name 19 
or line item, the funding source of the appropriation and a copy of the 20 
written request set forth in (1) above; 21 
(3)  Each Agency, Board, Commission or Institution shall provide a written 22 
report to the Arkansas Legislative Council or Joint Budget Committee 23 
containing all information set forth in item (2) above, along with a written 24 
statement as to the current status of the project, contract, purpose, etc.  25 
for which the carry forward was originally requested no later than thirty 26 
(30) days prior to the time the Agency, Board, Commission or Institution 27 
presents its budget request to the Arkansas Legislative Council or Joint 28 
Budget Committee; and 29 
(4)  Thereupon, the Department of Finance and Administration shall include 30 
all information obtained in item (3) above in the biennial budget manuals 31 
and/or a statement of non -compliance by the Agency, Board, Commission or 32 
Institution. 33 
 The provisions of this section shall be in effect only from July 1, 34 
2024 2025 through June 30, 2025 2026. 35

 SECTION 42. COMPLIANCE WITH OTHER LAWS.  Disbursement of funds 1 
authorized by this act shall be limited to the appropriation for such agency 2 
and funds made available by law for the support of such appropriations; and 3 
the restrictions of the State Procurement Law, the General Accounting and 4 
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 5 
Procedures and Restrictions Act, or their successors, and other fiscal 6 
control laws of this State, where applicable, and regulations promulgated by 7 
the Department of Finance and Administration, as authorized by law, shall be 8 
strictly complied with in disbursement of said funds. 9 
 10 
 SECTION 43. LEGISLATIVE INTENT.  It is the intent of the General 11 
Assembly that any funds disbursed under the authority of the appropriations 12 
contained in this act shall be in compliance with the stated reasons for 13 
which this act was adopted, as evidenced by the Agency Requests, Executive 14 
Recommendations and Legislative Recommendations contained in the budget 15 
manuals prepared by the Department of Finance and Administration, letters, or 16 
summarized oral testimony in the official minutes of the Arkansas Legislative 17 
Council or Joint Budget Committee which relate to its passage and adoption. 18 
 19 
 SECTION 44. EMERGENCY CLAUSE.  It is found and determined by the 20 
General Assembly, that the Constitution of the State of Arkansas prohibits 21 
the appropriation of funds for more than a one (1) year period; that the 22 
effectiveness of this Act on July 1, 2025 is essential to the operation of 23 
the agency for which the appropriations in this Act are provided, and that in 24 
the event of an extension of the legislative session, the delay in the 25 
effective date of this Act beyond July 1, 2025 could work irreparable harm 26 
upon the proper administration and provision of essential governmental 27 
programs. Therefore, an emergency is hereby declared to exist and this Act 28 
being necessary for the immediate preservation of the public peace, health 29 
and safety shall be in full force and effect from and after July 1, 2025. 30
