Assigned to GOV FOR COMMITTEE ARIZONA STATE SENATE Fifty-Fifth Legislature, Second Regular Session FACT SHEET FOR H.B. 2012 county improvement districts; formation Purpose Requires a petition to a county board of supervisors (county BOS) requesting the establishment of a county improvement district to be signed by both, rather than either, a majority of the persons owning real property and by the owners of at least 51 percent of the real property within the limits of the proposed district. Background A county BOS may establish a county improvement district in any unincorporated area for the purpose of constructing and operating a wastewater treatment facility and making other authorized local improvements or acquisitions (A.R.S. § 48-902). A petition addressed to a county BOS requesting the establishment of a county improvement district may be filed with the clerk of a county BOS if signed by a majority of the persons owning real property or by the owners of at least 51 percent of the real property within the limits of the proposed county improvement district. The petition must include, for the proposed county improvement district: 1) the name; 2) the necessity for the county improvement district; 3) an attestation that the public convenience, necessity or welfare will be promoted and that the property to be included in the county improvement district will be benefited; 4) the proposed boundaries; 5) a general outline of the proposed improvement; and 6) any other statutory requirements (A.R.S. § 48-903). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1.
