HB 2085: nursing facility provider assessments; continuation

Overview 
Extends the delayed repeal date of the nursing facility provider assessment (assessment) to 
October 1, 2031.  
History 
Laws 2012, Chapter 213 established a provider assessment on nursing facilities in Arizona. The 
Arizona Health Care Cost Containment System (AHCCCS) calculates the assessment on a per 
resident day basis exclusive of Medicare resident days. The assessment is capped at 3.5 percent 
of net patient service revenue. 
If a nursing facility fails to pay the assessment, AHCCCS is authorized to suspend or revoke the 
nursing facility's AHCCCS provider agreement registration. If the nursing facility does not comply 
within 180 days after the Director of AHCCCS suspends or revokes the agreement, the Director 
of AHCCCS must notify the Director of the Arizona Department of Health Services to suspend or 
revoke the nursing facilities license (A.R.S. §§ 36-2999.52 and 36-2999.54). 
The assessment is set to repeal on October 1, 2023.
