same day voter registration; prohibition 
Purpose 
Prohibits same day voter registration and classifies registering a person to vote on election 
day and deeming the person eligible to vote in that election as a class 6 felony. 
Background 
An elector may not vote in an election unless the elector has been registered to vote as a 
resident and the registration has been received by the county recorder or recorder's designee before 
midnight 29 days before the election (A.R.S. § 16-120). A county recorder must authorize persons 
to accept registration forms, designate places for receipt of registration forms and designate 
additional locations for distribution of voter registration forms. A mailed voter registration is valid 
for an election if: 1) the form is postmarked 29 days or more before an election and is received by 
7:00 p.m. on election day; or 2) the registration is dated 29 days before the election and is received 
by the county recorder by first class mail within 5 days after the last day to register to vote in the 
election (A.R.S. § 16-134).   
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation.  
Provisions 
1. Prohibits a state agency, department or division, political subdivision or person acting on 
behalf of the state or a political subdivision from registering a person to vote on an election 
day and deeming the person eligible to vote in that election. 
2. Classifies, as a class 6 felony, registering a person to vote on election day and deeming the 
person eligible to vote in that election. 
3. Becomes effective on the general effective date.
