insurance; secondary sources 
Purpose 
Prohibits a secondary source on insurance from being considered a source of Arizona law 
or public policy.  
Background 
Statute authorizes and outlines the transaction of insurance business in Arizona. The laws 
and rules regarding insurer licensure and insurance contracts vary by type of insurance  
(A.R.S. Title 20). 
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation.  
Provisions 
1. Determines that a secondary source on insurance, including any legal treatise, scholarly 
publication, textbook or other explanatory text, does not constitute the law or public policy of 
Arizona and is not authoritative if the secondary source purports to create, eliminate, expand 
or restrict a cause of action, right or remedy or if it conflicts with:  
a) the Arizona or U.S. Constitution; 
b) state law; 
c) Arizona case law precedent; or 
d) other common law that may have been adopted by the state. 
2. Becomes effective on the general effective date.
