Sponsor: Representative Kavanagh, LD 23
House Engrossed
Overview
Requires superior court probation departments to submit information about individuals placed on
supervised probation for federal immigration law violations and offense convictions to the Arizona
Criminal Justice Commission (ACJC).
History
ACJC must, among other duties:
1) Monitor the progress and implementation of continuing criminal justice legislation;
2) Maintain criminal justice system information; and
3) Provide reports on criminal justice issues (A.R.S. § 41-2405).
To perform its functions ACJC may:
1) Form subcommittees, make studies and hold hearings;
2) Employ consultants for special projects;
3) Delegate its duties;
4) Establish joint research and information research with other agencies;
5) Accept and expend money grants (A.R.S. § 41-2405).
ACJC is designated as the central collection point for criminal justice data collection. ACJC may
require any state criminal justice agency to submit necessary information readily reportable by
the agency. ACJC is prohibited from requiring state criminal justice agencies to maintain new data
that is not currently collected by the agency (A.R.S. § 41-2408).
