AN ACT

 

amending title 40, chapter 2, article 1, Arizona Revised Statutes, by adding section 40-213; relating to regulation by the corporation commission.

 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 40, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 40-213, to read: START_STATUTE40-213. Electric charging providers; exception; definition A. NOtwithstanding any other law, eLECTRIC CHARGING PROVIDErs ARE NOT PUBLIC service corporations UNDER ARTICLE XV, SECTION 2, CONSTITUTION OF ARIZONA, AND ARE NOT SUBJECT TO THIS CHAPTER. B. IN ADDITION TO THE FEE ASSESSED FOR THE QUANTITY OF ELECTRICAL ENERGY SOLD, FEES MAY BE ASSESSED FOR OTHER SERVICES and may BE BASED ON TIME MEASUREMENT or A FIXED FEE or both. C. For the purposes of this section, "ELECTRIC charging providers" means entities THAT both: 1. OFFER THE USE OF SPECIALIZED EQUIPMENT FOR THE SPECIFIC PURPOSE OF CHARGING BATTERIES FOR ELECTRIC VEHICLES. 2. SELL ELECTRICITY FOR THE PURPOSE OF CHARGING BATTERIES FOR ELECTRIC VEHICLES BY KILOWATT HOUR OR BY MEGAJOULE. END_STATUTE 

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 40, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 40-213, to read:

A. NOtwithstanding any other law, eLECTRIC CHARGING PROVIDErs ARE NOT PUBLIC service corporations UNDER ARTICLE XV, SECTION 2, CONSTITUTION OF ARIZONA, AND ARE NOT SUBJECT TO THIS CHAPTER.

B. IN ADDITION TO THE FEE ASSESSED FOR THE QUANTITY OF ELECTRICAL ENERGY SOLD, FEES MAY BE ASSESSED FOR OTHER SERVICES and may BE BASED ON TIME MEASUREMENT or A FIXED FEE or both.
