FACT SHEET FOR H.B. 2591 
 
border security fund; administration 
Purpose 
An emergency measure that allows the Department of Emergency and Military Affairs 
(DEMA) to use up to $250,000 from the Border Security Fund (Fund) each fiscal year to 
administer the Fund and hire additional full-time equivalent positions (FTEs). 
Background 
The Fund consists of legislative appropriations, gifts, grants and other donations and is 
administered by DEMA. Fund monies may be used to: 1) prevent human trafficking; 2) prevent 
entry into the U.S. of illegal aliens, terrorists, instruments of terrorism, contraband, narcotics and 
controlled substances; 3) plan, design, construct and maintain transportation, technology and 
commercial vehicle inspection infrastructure near the international border; 4) clear nonindigenous 
plants; 5) administer and manage the construction and maintenance of a physical border fence;  
6) award grants to counties to provide housing in secure facilities; and 7) award grants to counties 
for prosecuting individuals that commit any of the outlined crimes (A.R.S. ยง 26-105). 
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation. 
Provisions 
1. Allows DEMA to use up to $250,000 from the Fund each fiscal year to administer the Fund. 
2. Authorizes DEMA to hire additional FTEs paid by administration monies from the Fund.  
3. Makes conforming changes. 
4. Becomes effective on signature of the Governor, if the emergency clause is enacted.
