HB 2604 Initials LC/JH Page 1 Judiciary ARIZONA HOUSE OF REPRESENTATIVES Fifty-fifth Legislature Second Regular Session HB 2604: commission; review of laws Sponsor: Representative Bolick, LD 20 Committee on Judiciary Overview Establishes the Commission on Review of Laws (Commission) and prescribes the Commission's member requirements and mandated duties. History The United States Commission on Civil Rights was established by the Civil Rights Act of 1957 and is tasked with investigating, reporting on and making recommendations to Congress concerning civil rights laws and issues. The Commission oversees fifty-six advisory committees for all fifty states, the District of Colombia and five territories of the United States which report findings and recommendations to the President, Congress and the public concerning civil rights (42 U.S.C. § 1945). Laws 2021, Chapter 187 § 5 established the Arizona Uniform Laws Commission, which is tasked with reviewing national efforts to enact uniform laws. The Uniform Laws Commission is required to make recommendations to the Governor and the Legislature concerning the adoption of certain uniform legislation (A.R.S. § 41-151.15). Provisions 1. Establishes the Commission on Review of Laws. (Sec. 2) 2. Designates the following Commission members: a) Three members appointed by the Governor; b) Two members appointed by the President of the Senate; c) Two members appointed by the Speaker of the House of Representatives; and d) Two members appointed by the Chief Justice of the Supreme Court. (Sec. 2) 3. Requires the officials making the Commission member appointments to ensure the inclusion of representatives from all areas of the criminal justice system. (Sec. 2) 4. Directs the Governor to designate a member of the Commission to serve as chairperson. (Sec. 2) 5. Specifies that Commission members are not eligible to receive compensation or reimbursement of expenses. (Sec. 2) 6. Requires the Commission do the following: a) Study and review all Arizona penal laws, other than criminal laws, involving controlled substances or relating to motor vehicle operation; b) Make recommendations to the Legislature regarding the repeal or revision of laws; c) Submit a report of its findings to the Governor, Legislature and the Chief Justice of the Supreme Court. Instructs the standing House and Senate Committees overseeing criminal justice matters to recommend a bill enacting the Commission's recommendations. (Sec. 2) 8. Mandates the court expunge the record of any living person serving, or who has served a sentence, or paid fines or fees related to any law the Commission determined to be unnecessary or outdated. (Sec. 2)
