HB 2605 Initials LC/DG Page 1 House Engrossed ARIZONA HOUSE OF REPRESENTATIVES Fifty-fifth Legislature Second Regular Session House: JUD DPA 9-0-0-1 HB2605: duty to report; requirements; interviews Sponsor: Representative Bolick, LD 20 House Engrossed Overview Prohibits an individual from relinquishing their duty to report the abuse or neglect of a minor to another individual, except for certain physicians who may delegate their duty to a subordinate. History Individuals required to report the abuse or neglect of minors include, but are not limited to, any physician, child welfare investigator and school personnel. An individual has a duty to report the abuse of minor or impart that duty to another individual. The individual must report the abuse of a minor to the appropriate authority (A.R.S. § 13-3620). Reports must be made immediately by telephone or electronic communication. The reports contains: 1) The names and addresses of the minor and their guardian; 2) The minor's age and extent of their abuse; and 3) Any other applicable information (A.R.S. § 13-3620). An individual who is required to receive reports may perform a medical examination of the involved minor (A.R.S. § 13-3620). An individual that fails to report the abuse of a minor is guilty of a class 1 misdemeanor. If the failure to report involves a reportable offense, the individual is guilty of a class 6 felony (A.R.S. § 13-3620). Reportable offenses include, but are not limited to, the intentional or knowing electronic transmission to a minor an item that is harmful to minors (A.R.S. § 13-3506.01). Provisions 1. Establishes that an individual has a duty to report when they reasonably believe that a minor is, or has been, a victim of abuse or neglect. (Sec. 1) 2. Prohibits the individual from designating their duty to report to another individual. (Sec. 1) 3. Allows a person required to receive child abuse reports to perform forensic interviews on the involved minor. (Sec. 1) 4. Specifies that an individual required to receive child abuse reports may perform forensic interviews and medical examinations of the involved minor. (Sec. 1) 5. Allows specified physicians who are required to make a report to delegate their duty to a subordinate. (Sec. 1) 6. Revises reportable offenses to include, but not limited to, the reckless physical distribution to minors any item that is considered harmful to minors.
