Overview
Modifies the definition of employer as it relates to employment discrimination.
History
Employer, as defined within the discrimination in employment statutes, means:
1) A person who has 15 or more employees for each working day in each of 20 or more
calendar weeks in the current or preceding calendar year; and
2) To the extent that the person is alleged to have commit any act of sexual harassment, a
person who has one or more employees in the current or preceding calendar year (A.R.S.
§ 41-1461).
Pursuant to A.R.S. § 41-1464, it is an unlawful employment practice for an employer to
discriminate against an employee who has opposed any unlawful employment practice or has
made a charge, testified, assisted or participated in any manner in an investigation, proceeding
or hearing arising from employment discrimination.
Provisions
1. Modifies the definition of employer to include a person who has one or more employees, in
the current or preceding calendar year, to the extent that the person is alleged to have
discriminated against anyone for opposing sexual harassment or making a charge, testifying,
