HB 2694: department of real estate; fees
Sponsor: Representative Toma, LD 22
Senate Engrossed
Overview
Eliminates the minimum fee amounts relating to real estate licensure.
History
Arizona Department of Real Estate (ADRE) was established in 1921 and administers real estate
laws for the purpose of protecting the public interest through licensure and regulation of the real
estate profession in Arizona. The Department regulates and issues licenses for real estate and
membership camping brokers and salespersons and cemeteries. The Department oversees the
activities of licensees, investigates complaints against licensees and land developers, participates
in administrative hearings and administers the Homeowners Association Dispute Process. ADRE
is directed by the Real Estate Commissioner, who is appointed by the Governor (Title 31, Chapter
2, A.R.S.).
ADRE requires applicants, for real estate salesperson's licenses and real estate broker's licenses,
to complete a real estate course that is approved by ADRE and to pass an examination on that
course. The course must be at least 90 classroom hours of instruction in a real estate school
certified by ADRE. Statute additionally permits an applicant to complete the real estate course
online if the online course is offered by a real estate school that is certified by ADRE, but the
examination for the online course must still be in person (A.R.S. § 32-2124).
Statute outlines licensure fees which ADRE charges as follows:
1) Broker's examination application fee of $35-$125;
2) Broker's examination fee of $35-$100;
3) Broker's license fee of $75-$250;
4) Broker's renewal fee of $100-$400;
5) Salesperson's examination application fee of $15-$75;
6) Salesperson's examination fee of $15-$50;
7) Salesperson's license fee of $35-$125;
8) Salesperson's renewal fee of $60-$200;
9) Branch office broker's license fee or renewal fee of $60-$200;
10) Change of name and address of licensee fee of not more than $20;
11) Duplicate license fee of $5;
12) Reinstatement of license fee of $5;
13) Certificate of correctness of copy of records fee of $1, plus the cost of reproduction;
14) Temporary broker's license fee of $15-$50;
15) Temporary cemetery salesperson's license fee of $15-$50; and
16) Membership camping salesperson certificate of convenience fee of $15-$50
All monies collected from these fees are deposited in the state General Fund (A.R.S. §§ 32-2103;
32-2132).
