Overview 
Revises the penalties relating to violations of elections laws and the Elections Procedures Manual 
(manual). 
History 
The Secretary of State is tasked with prescribing rules to achieve and maintain the maximum 
degree of correctness, impartiality, uniformity and efficiency on the procedures for early voting 
and voting, and of producing, distributing, collecting, counting, tabulating and storing of ballots.  
After consultation with the county board of supervisors, the Secretary of State prescribes these 
rules in the creation of the manual (A.R.S. § 16-452).  
 
Current statute states that crimes involving elections and crimes against the elective franchise, 
and prescribing penalties therefor, apply to any general, primary or special election or to any 
election called by a board of supervisors (A.R.S. § 16-1001). 
 
Provisions 
1. Modifies the penalty for any person who violates rules adopted pursuant to statute relating to 
the manual from a class 2 misdemeanor to a class 1 misdemeanor. (Sec. 1) 
2. Stipulates that a person who violates elections statute is guilty of a class 6 felony unless 
statute defining the offense provides for a different classification. (Sec. 2)
