HCR2028: minimum law enforcement expenditure amount

Overview 
Amends the Arizona Constitution, subject to voter approval, to require a minimum law 
enforcement expenditure amount (amount) for each county, city and town each fiscal year.  
History 
The Economic Estimates Commission (EEC) is required to determine and report the following to 
the Legislature before January 15 each year: 
1) The estimated total personal income in Arizona for the next fiscal year; 
2) The estimated total personal income in Arizona for the current fiscal year; 
3) The estimated percentage change per capita of estimated total personal income in Arizona 
for the next fiscal year; and 
4) The estimated per capita personal income in Arizona for the current fiscal year (A.R.S. § 
41-562).  
In FY 2020, the City of Gilbert allocated $59,942,830 in its budget for Gilbert Police Department 
expenditures. In the 2021 annual report, it was projected that expenditures for Gilbert Police 
Department would total to $57,111,890 (Gilbert FY 2021 Annual Budget).  
Provisions 
1. Requires the EEC to determine and publish the amount for the following fiscal year for each 
county, city and town by April 1 of each year. (Sec. 1) 
2. Requires the amount be determined by adjusting the spending amount of local law 
enforcement services in each county, city or town in FY 2020 to reflect changes in population 
and cost of providing local law enforcement services. (Sec. 1) 
3. Prohibits the governing body of any county, city or town from authorizing law enforcement 
expenditures less than the amount for that county, city or town. (Sec. 1) 
4. Requires the Legislature to provide administration of the amount, including a reporting system, 
sanction and penalties for failure to comply with this amount. (Sec. 1) 
5. Requires the Secretary of State to submit this proposition to voters at the next general 
election. (Sec. 2)  
6. Contains a legislative intent clause. (Sec. 2)
