Assigned to APPROP FOR COMMITTEE ARIZONA STATE SENATE Fifty-Fifth Legislature, Second Regular Session FACT SHEET FOR S.B. 1459 event wagering; fantasy sports; fees Purpose Reduces the percentage of Fantasy Sports Contest Fund (FSC Fund) and Event Wagering Fund monies that the Arizona Department of Gaming (ADG) may spend on annual regulation and enforcement costs. Background In 2021, the Legislature authorized fantasy sports contests and event wagering according to prescribed regulations administered by the ADG (Laws 2021, Ch. 234). The FSC Fund consists of monies from the fee established for the privilege of operating fantasy sports contests and from any other source. FCS Fund monies are subject to legislative appropriation, and the ADG may spend up to 10 percent of monies on the ADG's annual costs for regulating and enforcing fantasy sports contest statutes, unless otherwise authorized by the Legislature. The ADG must transfer any remaining monies to the state General Fund (state GF) (A.R.S. § 5-1212). The Event Wagering Fund consist of monies from the fee established for the privilege of operating event wagering and any other source. On the 25th day of each month, any monies remaining in the Event Wagering Fund must be transferred to the state GF. Unless otherwise determined by the Legislature, the ADG may spend up to 10 percent of monies on the ADG's annual costs for regulating and enforcing event wagering statutes and any remaining monies revert to the state GF (A.R.S. § 5-1418). S.B. 1459 reduces the percentage of FSC Fund and Event Wagering Fund monies that the ADG may spend for regulation and enforcement. If the reduction changes the amount of remaining monies that must be transferred to the state GF, there may be a fiscal impact associated with this legislation. Provisions 1. Reduces, from 10 percent to 8 percent, the percentage of: a) FSC Fund monies that the ADG may spend on the annual costs for regulating and enforcing fantasy sports contest statutes; and b) Event Wagering Fund monies that the ADG may spend on the annual costs for regulating and enforcing event wagering statutes.
