AN ACT
amending Title 13, chapter 16, Arizona Revised Statutes, by adding section 13-1606; relating to criminal damage to property.

Be it enacted by the Legislature of the State of Arizona: Section 1. Title 13, chapter 16, Arizona Revised Statutes, is amended by adding section 13-1606, to read: START_STATUTE13-1606. Destroying, defacing or disturbing monuments and memorials; classification; definition A. it is unlawful for a person including a city, town, county or other political subdivision of this state to relocate, remove, alter, rename, rededicate, deface or otherwise disturb a statue, monument, memorial, nameplate, plaque, street, bridge, building, park preserve or reserve that is located on public property and that has been erected for or named or dedicated in honor of events in this state's or this country's military history or any historical military figure, historical military event, military organization or military unit. B. Subsection A of this section does not apply to a person, city, town, county or other political subdivision of this state that RECEIVES approval by a two-thirds majority vote of both houses of the legislature to relocate, remove, rename or in any other way alter a monument or memorial listed in subsection A of this section. C. A person who violates this section is guilty of a class 3 felony, and the court shall order restitution in an amount which, at a minimum, includes the full cost of repairing or replacing the memorial or historic property. D. for the purposes of this section, "public property" means property that is owned or leased by this state or a county, city, town or other political subdivision of this state. END_STATUTE
Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 16, Arizona Revised Statutes, is amended by adding section 13-1606, to read:
START_STATUTE13-1606. Destroying, defacing or disturbing monuments and memorials; classification; definition
A. it is unlawful for a person including a city, town, county or other political subdivision of this state to relocate, remove, alter, rename, rededicate, deface or otherwise disturb a statue, monument, memorial, nameplate, plaque, street, bridge, building, park preserve or reserve that is located on public property and that has been erected for or named or dedicated in honor of events in this state's or this country's military history or any historical military figure, historical military event, military organization or military unit.
B.
