AHCCCS; drug treatment; testing; reporting 
Purpose 
 Establishes the Arizona Health Care Cost Containment System (AHCCCS) Recovery 
Support and Accountability Program (Program), subject to approval by the U.S. Centers for 
Medicare and Medicaid Services (CMS), to incentivize providers to increase successful recovery 
by monitoring and supporting members who have graduated from an AHCCCS-funded treatment 
program. Incentivizes AHCCCS substance use treatment providers to implement transitional 
supports, including the use of random semi-monthly DNA-matched drug testing for the first six 
months after a member graduates from a treatment program. 
Background 
The Substance Use Disorder Treatment Services (Fund) is established under AHCCCS, 
consisting of appropriated monies, gifts or donations to the Fund and interest earned on those 
monies. Using monies from the Fund, AHCCCS must enter into agreements with contractors for 
substance use disorder services (A.R.S. § 36-2930.06). 
If there is an increased cost associated with implementing random drug testing, there may 
be a fiscal impact to the state General Fund. 
Provisions 
1. Establishes, subject to approval by CMS, the AHCCCS Program to incentivize providers to 
monitor and support members and increase successful recovery. 
2. Incentivizes AHCCCS substance use treatment providers to implement transitional supports, 
including random semi-monthly DNA-matched drug testing for the first six months after a 
member graduates from a treatment program, unless the member is on probation or parole. 
3. Requires, beginning October 1, 2023, AHCCCS to submit an annual report to the Governor, 
the President of the Senate, the Speaker of the House, the Chairpersons of the Health and 
Human Services committees in the Senate and the House of Representatives and the Secretary 
of State regarding AHCCCS-funded substance use disorder treatment programs.  
4. Requires the annual report to include: 
a) the total number of graduated members and their employment status; 
b) the percentage of graduated members who relapsed within the six-month tracking period; 
c) the number of graduated members who are the subjects of Department of Child Safety 
oversight, including the number of those members who are parents engaged in reunification 
or have been reunified with their children;  FACT SHEET – Amended

d) the number of graduated members who returned to an AHCCCS-funded drug treatment 
program within six months of graduation; and 
e) the number of graduated members who are identified as homeless or are in supportive sober 
living. 
5. Requires, by October 1, 2025, AHCCCS to notify the Director of Legislative Council in writing 
of either: 
a) the date that CMS approves the request to implement the Program; or 
b) the denial of the request. 
6. Conditions the enactment of this legislation on CMS approval by October 1, 2025. 
7. Becomes effective on the general effective date or later, subject to the provisions of the 
conditional enactment 
Amendments Adopted by Committee of the Whole 
1. Establishes, subject to approval by CMS, the AHCCCS Program to incentivize providers to 
monitor and support members and increase successful recovery. 
2. Incentivizes, rather than requires, providers to implement transitional supports for members 
who recently graduated from a drug treatment program, including the use of semimonthly 
DNA-matched drug testing. 
3. Removes the requirement that AHCCCS report the number of graduated members that are 
enrolled in school or job skills training as well as the number of members who own a home or 
who live with a friend or family member.  
4. Requires the AHCCCS report to include the number of graduated members that are identified 
as homeless or are living in supportive sober living. 
5. Adds a conditional enactment clause.
