FACT SHEET FOR H.B. 2216 
 
hazardous air pollutants program 
Purpose 
Allows, rather than requires, the Director of the Arizona Department of Environmental 
Quality (ADEQ) to establish a state program for the control of hazardous air pollutants.  
Background 
ADEQ must: 1) formulate policies and programs to protect the environment; 2) conduct 
research pertaining to department objectives; 3) provide information and advice on matters within 
the department's scope; 4) promote and coordinate the management of air resources to ensure their 
protection, enhancement and balanced utilization; 5) encourage industrial, commercial, residential 
and community development that maximizes environmental benefits and minimizes the effects of 
less desirable environmental conditions; and 6) provide for the prevention, abatement and control 
of air pollution (A.R.S. §§ 49-104 and 49-424).  
The Director of ADEQ must establish a state program for the control of hazardous air 
pollutants that applies to sources that: 1) emit or have the potential to emit with controls 10 tons 
or more per year of any hazardous air pollutant or 25 tons or more per year of any combination of 
hazardous air pollutants; and 2) are within a category designated by the Director of ADEQ and 
that emit or have the potential to emit with controls 1 ton or more per year of any hazardous air 
pollutant or 2.5 tons per year of any combination of hazardous air pollutants. The Director of 
ADEQ may designate: 1) hazardous air pollutants that are subject to regulation in Arizona, in 
addition to the federally listed hazardous air pollutants; and 2) by rule, a category of sources that 
are subject to the state program for control of hazardous air pollutants (A.R.S. §§ 49-426.04; 49-
426.05; and 49-426.06).  
A hazardous air pollutant is any federally listed hazardous air pollutant and any air 
pollutant that the Director of ADEQ has designated as a hazardous air pollutant (A.R.S.  
§ 49-401.01).  
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation.  
Provisions 
1. Allows, rather than requires, the Director of ADEQ to establish a state program for the control 
of hazardous air pollutants.  
2. Becomes effective on the general effective date.
