Purpose 
Allows a condominium unit owners' association (COA) and a planned community 
association (HOA) that restricts vehicular or pedestrian access to prohibit a person who is not 
accompanied by a unit owner or resident from entering the COA or HOA premises.  
Background 
A COA and HOA may not prohibit door-to-door political activity on property that is 
normally open to visitors, including the solicitation for candidates or ballot issues or the circulation 
of political petitions. However, a COA or HOA may restrict or prohibit the door-to-door political 
activity from sunset to sunrise and require the prominent display of an identification tag for each 
person engaging in the activity along with the identification of the candidate or ballot issue. A 
COA or HOA that restricts vehicular or pedestrian access to the condominium or planned 
community is exempt from the prohibition of a COA or HOA restricting or prohibiting door-to-
door political activity. A COA and HOA is not required to make its common elements other than 
roadways and sidewalks available for the circulation of political petitions to anyone who is not an 
owner or resident of the community. A COA and HOA may not prohibit or unreasonably restrict 
an owner's ability to peacefully assemble and use common areas of the community or 
condominium if done in compliance with the restrictions for the use of the property adopted by the 
board of directors (A.R.S. ยงยง 33-1261 and 33-1808). 
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation. 
Provisions 
1. Allows a COA and HOA that restricts vehicular or pedestrian access to prohibit a person who 
is not accompanied by a unit owner, resident of the condominium, member or resident of the 
planned community from entering the COA or HOA premises.  
2. Makes technical changes.  
3. Becomes effective on the general effective date.
