state immigration enforcement; urging Congress 
Purpose 
Urges the U.S. Congress to enact the federal State Immigration Enforcement Act or similar 
legislation. 
Background 
The Department of Homeland Security (DHS) engages in immigration enforcement actions 
to prevent unlawful entry into the United States and to apprehend and deport noncitizens who have 
violated or failed to comply with U.S. immigration laws. Primary responsibility for the 
enforcement of immigration law within DHS rests with U.S. Customs and Border Protection, U.S. 
Immigration and Customs Enforcement and U.S. Citizenship and Immigration Services (DHS).  
The federal State Immigration Enforcement Act allows states or political subdivisions of 
states to: 1) implement and enforce criminal penalties that would penalize conduct that is 
prohibited in the criminal provisions of immigration laws; and 2) enact, implement and enforce 
civil penalties that penalize conduct that is prohibited in the civil provisions of immigration laws 
(H.R. 9174, 117th Congress, 2022).  
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation. 
Provisions 
1. Urges the U.S. Congress to enact the federal State Immigration Enforcement Act or similar 
legislation.  
2. Directs the Secretary of State to transmit copies of this memorial to the President of the United 
States, the President of the U.S. Senate, the Speaker of the U.S. House of Representatives and 
each member of the U.S. Congress from Arizona.
