HB 2004 Initials EB/BSR Page 1 Natural Resources, Energy & Water ARIZONA HOUSE OF REPRESENTATIVES Fifty-sixth Legislature Second Regular Session HB 2004: utilities; electronic filings; corporation commission Sponsor: Representative Griffin, LD 19 Committee on Natural Resources, Energy & Water Overview Allows a utility to electronically submit an application to the Arizona Corporation Commission (ACC) for a Certificate of Environmental Compatibility (Certificate). Authorizes the ACC to adopt administrative rules related to electronic filings and notices. History Laws 1971, Chapter 67 authorized the ACC to establish the Power Plant and Transmission Line Siting Committee (Committee) to provide a single public forum for resolving issues related to locating electric generating plants and transmission lines. To build a transmission line, a utility is required to apply for and obtain a Certificate from the Committee and the ACC. The Committee reviews the application, conducts hearings, takes testimony from affected parties and evaluates evidence to determine if specified factors related to technical feasibility and environmental impact are met. If an application is approved by the Committee, the Certificate is forwarded to the ACC for review and final approval (A.R.S. §§ 40-360.03, 40-360.04, 40-360.06 and 40-360.07). Provisions 1. Allows a utility to submit an application for a Certificate to the ACC in an electronic format. 2. Permits the ACC to adopt administrative rules to accept Certificates electronically and provide electronic notification to interested parties. 3.
