HB 2130: counties; maximum acreage; energy production

Overview 
Allows a county Board of Supervisors (BOS) to adopt ordinances, or include in the county 
comprehensive plan, a maximum acreage allowed in the county for electric energy 
production. 
History 
Each county with a population of at least 175,000 people must have a BOS consisting of five 
members who are qualified electors of their supervisorial district, and are elected at each 
presidential election (A.R.S. § 11-211). 
One of the powers and duties of the Board is the ability to enact, make and enforce ordinances 
for the protection, regulation and restriction of certain services and regulations throughout 
the county (A.R.S. § 11-251). 
Provisions 
1. Allows each county BOS to adopt ordinances or, include in the county comprehensive 
plan, a maximum acreage allowed in the county that can be developed for electric energy 
production. (Sec. 1) 
2. Specifies the maximum acreage can include a set number of acres or a percentage of: 
a) the total land surface area of the county; 
b) state-owned land within the county; 
c) federally owned land within the county; and 
d) privately owned land within the county. (Sec. 1) 
3. Requires the county to include enough acreage to encompass the existing electric energy 
production facilities in the county at the time the BOS adopts the maximum acreage. (Sec. 
1) 
4. Stipulates that when calculating the maximum acreage allowance: 
a) the acreage attributed to wind farms or wind turbines is the total acreage of the 
boundary of the wind farm or site; and 
b) the maximum acreage does not include above-ground transmission infrastructure.

5. Requires each county BOS to convene within 90 days of the effective date of this 
legislation to determine whether the Board will establish a maximum acreage amount 
and the amount of the maximum acreage amount allowance. (Sec. 1) 
6. Allows the BOS to amend or repeal adopted ordinances. (Sec. 1) 
7. Defines electric energy production. (Sec. 1)
