FACT SHEET FOR H.C.M. 2001 
 
reevaluate restrictions; chemical industry 
Purpose 
Expresses the Legislature's encouragement for the President of the United States, federal 
agencies and the U.S. Congress to reevaluate proposed restrictions on the chemical industry. 
Background 
Several federal agencies work together, under various federal statutes and executive orders, 
to establish and enforce comprehensive chemical regulations that protect public health and the 
environment in the United States. The Environmental Protection Agency (EPA) regulates the 
manufacture, distribution, use and disposal of chemicals and establishes the majority of federal 
chemical regulations. The Food and Drug Administration (FDA) regulates chemicals used in food, 
drugs, cosmetics and other consumer products to ensure their safety and efficacy, including 
reviewing new chemical substances intended for use in foods and pharmaceuticals. The Consumer 
Product Safety Commission (CPSC) oversees chemical regulations in consumer products, 
including toys, furniture, electronics and household cleaners, and enforces consumer product 
safety standards. The U.S. Department of Transportation regulates the transportation of hazardous 
materials, including chemicals, to ensure safe handling and transportation by air, land and sea and 
prescribes packaging, labeling and training requirements for personnel involved in the 
transportation of chemicals (EPA; FDA; CPSC; U.S. DOT). 
There is no anticipated fiscal impact to the state General Fund associated with this 
legislation. 
Provisions 
1. Urges the President of the United States, federal agencies and the U.S. Congress to: 
a) reevaluate proposed restrictions on the chemical industry; 
b) ensure that regulations are based on sound science, promote innovation and support supply 
chain resiliency; and 
c) support frameworks that celebrate innovation and accelerate progress in the chemical 
industry. 
2. Directs the Secretary of State to transmit copies of the memorial to:  
a) the President of the United States; 
b) the President of the U.S. Senate; 
c) the Speaker of the U.S. House of Representatives; 
d) the directors of relevant federal agencies; and 
e) each Member of the U.S. Congress from Arizona.
