Assigned to GOV FOR COMMITTEE ARIZONA STATE SENATE Fifty-Sixth Legislature, Second Regular Session FACT SHEET FOR S.B. 1022 associations; appeal to heaven flags Purpose Precludes a condominium unit owners' association and a planned community association (HOA) from prohibiting the outdoor display of the An Appeal to Heaven flag. Background An HOA may not prohibit a member from the outdoor display of: 1) the American flag or an official or replica of a flag of the U.S. Army, Navy, Air Force, Marine Corps or Coast Guard; 2) the POW/MIA flag; 3) the Arizona state flag; 4) an Arizona Indian Nations flag; 5) the Gadsden flag; 6) a first responder flag; 7) a blue star service flag or gold star service flag; and 8) any historic version of the American flag, including the Betsy Ross flag, without regard to how the stars and stripes are arranged (A.R.S.ยงยง 33-1261 and 33-1808). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1. Precludes an HOA from prohibiting the outdoor display of the An Appeal to Heaven flag. 2. Defines An Appeal to Heaven flag as a historic flag of the Revolutionary War consisting of a green pine tree on a white background with the words "An Appeal to Heaven" placed above the pine tree. 3.
