Originally assigned to JUD AS PASSED BY HOUSE Now TTMC-related ARIZONA STATE SENATE Fifty-Sixth Legislature, Second Regular Session AMENDED FACT SHEET FOR S.B. 1196 prisoners; transition services; noncontracted entities (NOW: vehicle lighting; law enforcement; exceptions) As passed by the Senate, S.B. 1196 allowed noncontracted entities to provide eligible inmates with transition program services and outlined requirements the noncontracted entity must fulfill to provide services to eligible inmates. The House of Representatives adopted a strike-everything amendment that does the following: Purpose Adds, as an exception to outlined lamp restrictions, an emergency vehicle or a vehicle with a red or red and blue light or lens used for traffic control by an off-duty law enforcement officer. Background At any time from sunset to sunrise and when there is not sufficient light to render clearly discernible persons and vehicles at 500 feet, a vehicle on a highway in Arizona must display lighted lamps and illuminating devices as required for different vehicle classes, subject to perking exceptions. Front clearance lamps and marker lamps and reflectors mounted on the front, or side near the front, of a vehicle must display or reflect an amber color (A.R.S. §§ 28-922 and 28-931). A person may not drive or move a vehicle or equipment on a highway with a lamp or device on the vehicle that can display a red or red and blue light or lens visible from directly in front of the center of the vehicle. All lights visible from the front of a vehicle must be amber or white. These lamp restrictions do not apply to: 1) an authorized emergency vehicle or a vehicle on which a red or red and blue light or lens visible from the front is expressly authorized or required; or 2) an emergency vehicle that is solely used for hobby or display purposes and has been issued a historic vehicle license plate if the lights are activated only in a parade for an authorized assemblage of historic vehicles or for testing purposes and are covered and not activated while being transported (A.R.S. § 28-947). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1. Excludes, from the outlined lamp restrictions, an authorized emergency vehicle or a vehicle on which a red or red and blue light or lens visible from the front used by a law enforcement officer for traffic control while employed in an off-duty capacity for an entity other than the law enforcement agency. 2. Becomes effective on the general effective date.
