SB 1237 Initials EB Page 1 Land, Agriculture & Rural Affairs ARIZONA HOUSE OF REPRESENTATIVES Fifty-sixth Legislature Second Regular Session SB 1237: working animals; restrictions; prohibition Sponsor: Senator Shamp, LD 29 Committee on Land, Agriculture & Rural Affairs Overview Prohibits a municipality or county from enacting any ordinance that restricts a person from using a working animal in a lawful commerce for an animal enterprise. History Agricultural operations are all activities by the owner, lessee, independent contractor and supplier conducted on any facility for the production of crops, livestock, poultry, livestock products or poultry products or for the purposes of agritourism (A.R.S. § 3-111). A county board of supervisors may adopt ordinances for the protection and disposition of domestic animals subject to inhumane or dangerous conditions. Additionally, a county ordinance can prohibit the running at large of dogs, except dogs used for control of livestock or while being used or trained for hunting (A.R.S. §§ 11-251, 11-1005). Provisions 1. Prohibits a municipality or county from enacting any ordinance, resolution or policy that prohibits or unduly restricts a person from using a working animal in lawful commerce for an animal enterprise. (Sec. 1, 2) 2. Specifies that the prohibition does not apply to: a) a municipal zoning ordinance; b) a municipal ordinance or resolution enacted relating to public health and safety or noise or animal cruelty; or c) any other Arizona law relating to animal care, animal cruelty, noise, public health or safety.
