Assigned to TTMC AS PASSED BY COMMITTEE ARIZONA STATE SENATE Fifty-Sixth Legislature, Second Regular Session AMENDED FACT SHEET FOR S.C.R. 1002 prohibit tax; monitoring; vehicle mileage Purpose Subject to voter approval, constitutionally prohibits a tax or fee based on vehicle miles traveled and any rule or law that monitors or limits vehicle miles of travel, excluding a rule or law that requires voluntary consent and certain interstate agreements. Background Vehicle miles traveled is the number of miles traveled by a motor vehicle for commute trips. A mile traveled by a reduced emission vehicle must be counted as less than a full vehicle mile traveled for travel reduction plan purposes (A.R.S. § 49-581). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1. Prohibits the state or any county, city, town, municipal corporation or political subdivision of the state from: a) imposing a tax or fee based on vehicle miles traveled by a person in a motor vehicle; and b) enacting any rule or law to monitor or limit the vehicle miles traveled by a person in a motor vehicle. 2. Excludes, from the prohibition, a rule or law that requires the person to voluntarily consent to the monitoring or limitation. 3. Exempts, from the prohibition, an interstate agreement that is established to administer the payment or reporting of fuel taxes or registration fees for commercial vehicles that operate in more than one state. 4. Requires the Secretary of State to submit the proposition to the voters at the next general election. 5. Becomes effective if approved by the voters and on proclamation of the Governor. Amendments Adopted by Committee 1. Excludes a rule or law that requires the voluntarily consent of the person from the prohibition. 2.
